Court Rules U.S. Nuclear Weapons Production Plan Violates Federal Law

AIKEN, S.C. — On September 30, United States District Court Judge Mary Geiger Lewis ruled that the United States Department of Energy (“DOE”) and its semi-autonomous nuclear weapons agency, the National Nuclear Security Administration (“NNSA”), violated the National Environmental Policy Act (“NEPA”) by failing to properly consider alternatives before proceeding with their plan to produce plutonium pits, a critical component of nuclear weapons, at the Los Alamos National Laboratory (“LANL”) in New Mexico and, for the first time ever, at the Savannah River Site (“SRS”) in South Carolina.
The Court found that the plan’s purpose had fundamentally changed from NNSA’s earlier analyses which had not considered simultaneous pit production at two sites. These changes necessitated a reevaluation of alternatives, including site alternatives, which Defendants failed to undertake prior to moving forward while spending tens of billions of taxpayers’ dollars. Therefore, the Court entered judgment in favor of Plaintiffs, the nonprofit public interest groups Savannah River Site Watch, Nuclear Water New Mexico and Tri-Valley Communities Against a Radioactive Environment (CAREs); the Gullah/Geechee Sea Island Coalition; and Tom Clements as an individual plaintiff.
As a result of this ruling, the Defendants are required to newly assess pit production at a nation-wide programmatic level which will mean undertaking a thorough analysis of the impacts of pit production at DOE sites throughout the United States, including radioactive waste generation and disposal. Under the National Environmental Policy Act (NEPA), this will provide the opportunity for public scrutiny of and formal comment on their assessments.

Santa Fe, NM – In April Nuclear Watch New Mexico released a map of plutonium contamination based on Lab data. Today, Dr. Michael Ketterer, Professor Emeritus of Chemistry and Biochemistry, Northern Arizona University, is releasing alarmingly high results from samples taken from a popular walking trail in the Los Alamos Town Site, including detections of some of the earliest plutonium produced by humankind.
On July 2 and 17 Dr. Ketterer, with the assistance of Nuclear Watch New Mexico, collected water, soil and plant samples from Acid Canyon in the Los Alamos Town Site and soil and plant samples in Los Alamos Canyon at the Totavi gas station downstream from the Lab. The samples were prepared and analyzed by mass spectrometry at Northern Arizona University to measure concentrations of plutonium, and to ascertain its sources in the environment.
NNSA Delays Urgent Research on Plutonium “Pit” Aging While Spending Tens of Billions on Nuclear Weapons Bomb Core Production

Nearly three years after filing a Freedom of Information Act request, the public interest group Savannah River Site Watch has finally received the National Nuclear Security Administration’s (NNSA’s) congressionally-required “Research Program Plan for Plutonium and Pit Aging.” However, the document is 40% blacked out, including references and acronyms. Plutonium “pits” are the radioactive cores of all U.S. nuclear weapons. The NNSA claims that potential aging effects are justification for a ~$60 billion program to expand production. However, the Plan fails to show that aging is a current problem. To the contrary, it demonstrates that NNSA is delaying urgently needed updated plutonium pit aging research.
In 2006 independent scientific experts known as the JASONs concluded that plutonium pits last at least 85 years without specifying an end date [i] (the average pit age is now around 40 years). A 2012 follow-on study by the Lawrence Livermore nuclear weapons lab concluded:
“This continuing work shows that no unexpected aging issues are appearing in plutonium that has been accelerated to an equivalent of ~ 150 years of age. The results of this work are consistent with, and further reinforce, the Department of Energy Record of Decision to pursue a limited pit manufacturing capability in existing and planned facilities at Los Alamos instead of constructing a new, very large pit manufacturing facility…” [ii]
Since then NNSA has reversed itself. In 2018 the agency decided to pursue the simultaneous production of at least 30 pits per year at the Los Alamos National Laboratory (LANL) in northern New Mexico and at least 50 pits per year at the Savannah River Site (SRS) in South Carolina. Upgrades to plutonium facilities at LANL are slated to cost $8 billion over the next 5 years. The redundant Savannah River Plutonium Processing Facility in South Carolina will cost up to $25 billion, making it the second most expensive building in human history.

Santa Fe, NM – Ironically the day after the film Oppenheimer was awarded multiple Oscars, the Department of Energy’s semi-autonomous National Nuclear Security Administration (NNSA) asked Congress for its biggest nuclear weapons budget ever. NNSA’s FY 2025 request for “Total Weapons Activities” is $19.8 billion, $700 million above what Congress recently enacted for FY 2024. It is also a full billion dollars above what President Biden asked for last year, which Congress then added to and will likely do so again.
The Biden Administration states that the $19.8 billion will be used to:
“[P]rioritize implementation of the 2022 National Defense Strategy and Nuclear Posture Review by modernizing the Nation’s nuclear deterrent to keep the American people safe. The Budget supports a safe, secure, reliable, and effective nuclear stockpile and a resilient, responsive nuclear security enterprise necessary to protect the U.S. homeland and allies from growing international threats.” whitehouse.gov/wp-content/uploads/2024/03/budget_fy2025.pdf, page 75.
The 2022 National Defense Strategy and Nuclear Posture Review for the first time posited two nuclear “near peers”, i.e. Russia and China, that need to be simultaneously “deterred.” This hinted at a potentially large nuclear buildup which this budget may now be implementing. That claimed need to deter two nuclear near peers was explicitly taken a step beyond just deterrence in an October 2023 report from the Strategic Posture Commission. It declared:
“Decisions need to be made now in order for the nation to be prepared to address the threats from these two nuclear-armed adversaries arising during the 2027-2035 timeframe. NNSA Suppresses How Taxpayers Money Is Spent

Santa Fe, NM – The National Nuclear Security Administration (NNSA) has just released cursory two or three page summaries of contractors’ performance paid for by the American taxpayer. For the just ended fiscal year 2023, NNSA gave nothing less than grades of “Excellent” or “Very Good” in six broad mission goals for its major contractors. This is despite the constant cost overruns and schedule delays that are the rule, not the exception, in the nation-wide nuclear weapons complex. NNSA and its parent Department of Energy have been on the Government Accountability Office’s “High Risk List” for project mismanagement ever since GAO started that List in 1991.
A current example is the Uranium Processing Facility (UPF) at the Y-12 Plant near Oak Ridge, Tennessee, originally estimated in 2011 to cost $1.4 to $3.5 billion. After costs started going through the roof, NNSA and Senator Lamar Alexander (R.-TN), then-chair of Senate Energy and Water Appropriations, swore that UPF would never go over $6.5 billion. But even after eliminating non-nuclear weapons production missions and a formal decision to continue operations at two old, unsafe buildings slated for replacement, the Uranium Processing Facility is now estimated to cost $8.5 billion. However, even that is not the final price, as NNSA is still to “rebaseline” UPF costs at some unspecified date.

Independent Government Accountability Office Releases Scathing Report on Expanding Plutonium Pit Production; Pressure Mounts on Los Alamos Lab to Increase Production

Santa Fe, NM – Today, the independent Government Accountability Office (GAO) released a scathing report entitled NNSA Does Not Have a Comprehensive Schedule or Cost Estimate for Pit Production Capability. The National Nuclear Security Administration (NNSA) and its parent Department of Energy have been on the GAO’s High Risk List for project mismanagement since 1991.
Plutonium pits are the essential radioactive cores of nuclear weapons. There has been only limited production at the Los Alamos National Laboratory (LANL) since 1989 when a FBI raid investigating environmental crimes abruptly shut down production at the Rocky Flats Plant near Denver. NNSA now plans to spend $2.9 billion in FY 2023 alone to establish production of at least 30 pits per year at LANL and 50 pits per year at the Savannah River Site (SRS) in South Carolina.

Los Alamos Lab: More Plutonium, More Nuclear Weapons

Santa Fe, NM – On Good Friday afternoon, just before the Easter weekend, the Department of Energy (DOE) posted its “Laboratory Tables”, the best source for site specific budget information. DOE boosts funding for the Los Alamos National Laboratory (LANL) to $4.6 billion in FY 2023 (+21%), which begins October 1. With another typical $300 million in “Work for Others” (the Defense Department, FBI, CIA, etc.), LANL’s total institutional funding for FY 2023 will be approximately $4.9 billion.
Out of that, $3.6 billion is slated for core nuclear weapons research and production programs. The percentage of nuclear weapons funding at LANL has steadily grown as the Lab increasingly banks its future on plutonium “pit” bomb core production. A decade ago, nuclear weapons programs were 59% of LANL’s total institutional budget. Today it is 73%. Moreover, the remainder of Lab programs (including nonproliferation and cleanup) either directly or indirectly support nuclear weapons programs, for example through a 6% internal tax for “laboratory-directed research and development” that has historically tilted towards nuclear weapons.
LANL’s largest funding increase is for “Plutonium Modernization”, jumping 61% to $1.6 billion in FY 2023. Within that, funding to expand the production of plutonium “pit” bomb cores at LANL’s aging plutonium pit production facility is increased 68% to $588 million.
Biden’s FY 2023 Budget Fuels New Nuclear Arms Race

Santa Fe, NM – The Biden Administration is slow rolling its nuclear weapons budget for the federal fiscal year 2023, which will begin October 1, 2022. Top line budget numbers released on March 24 showed that Biden is increasing the National Nuclear Security Administration’s (NNSA’s) budget category for “Total Weapons Activities” by 7.4% to $16.5 billion. That may seem like a relatively modest increase, especially given accelerating inflation.
However, huge increases in specific programs have now been disclosed in an obscure budget chart entitled “Comparative Appropriation by Congressional Control FY 2023.” These NNSA programs are the tip of the spear in the United States’ $1.7 trillion nuclear weapons “modernization” program. It will rebuild every nuclear warhead in the planned stockpile with new military capabilities; design and manufacture new-design nuclear weapons as well; construct new production plants expected to be operational until the 2080’s; and procure at enormous taxpayers’ expense new missiles, subs and bombers to deliver these weapons of mass destruction. It is, in short, a program of nuclear weapons forever.
NukeWatch Lawsuit Settlement Speeds Up Cleanup at Los Alamos Lab

Santa Fe, NM – Today, Nuclear Watch New Mexico is announcing successful settlement of a lawsuit it brought against the Department of Energy (DOE) over its slow cleanup of the Los Alamos National Laboratory (LANL). The watchdogs’ lawsuit alleged violations of a 2005 Consent Order, which was a site-wide cleanup agreement between the New Mexico Environment Department (NMED) and DOE to address radioactive and toxic wastes at the Lab. NMED has since sued DOE to terminate a revised 2016 Consent Order issued under the Martinez Administration that is far weaker than the original 2005 Order.
After a six-year court battle, NukeWatch’s settlement agreement requires DOE to:
- Reestablish a surface water flow monitoring station near where the Los Alamos Canyon meets the Rio Grande. This is critical because the Canyon has long been a known pathway for plutonium contaminants to migrate as far as 20 miles south to Cochiti Lake, a popular recreational area. The Buckman Direct Diversion Project (BDDP), three miles south of the Canyon, supplies drinking water directly out of the river to the City and County of Santa Fe. The original monitoring station warned the BDDP to close its intake gates as a precaution during stormwater events and allowed characterization of the radioactive contaminants in the stormwater flows.” However, it was destroyed during a 2013 flood and DOE had refused to reinstall it ever since, despite repeated BDDP requests. Meanwhile, during that same period of time, funding doubled for LANL’s nuclear weapons research and production programs that caused the radioactive and toxic pollution to begin with.
NNSA Whitewashes LANL Performance, Hides Information from Taxpayers

Santa Fe, NM – Today the National Nuclear Security Administration (NNSA) released cursory three-page summaries of its FY 2021 Performance Evaluation Reports (PERs) which grade contractor performance at its eight nuclear weapons sites. Out of six missions goals the NNSA gave the Los Alamos National Laboratory (LANL) two “Excellent” and four “Very Good,” thereby awarding 87% of the at-risk award fee of $26 million to Triad National Security, LLC, the Management and Operating Contractor. In all, including the fixed fee of $20.5 million, Triad will receive $46.7 million for its FY 2021 contractor performance.[1]
The NNSA is releasing only summaries of the Performance Evaluation Reports (“Performance Evaluation Summaries”), which provide scant information and essentially whitewash contractor performance. For context, the Department of Energy’s nuclear weapons and cleanup programs have been on the Government Accountability Office’s High Risk List for project and contractor mismanagement for 27 consecutive years. In 2012 Nuclear Watch New Mexico sued to obtain the full and complete Performance Evaluation Reports, after which NNSA caved in and immediately provided them. However, that unfortunately resulted in no legal settlement requiring annual releases of the full and complete PERs, and now the agency is back to suppressing information of contractor performance paid for by the American taxpayer.
Groups Fire Back at Feds’ Move to Dismiss Plutonium Pit Lawsuit
Federal agencies continue to reject a full review of the public safety and environmental risks of producing nuclear bomb cores at multiple DOE sites.

AIKEN, SOUTH CAROLINA — Public interest groups shot back at the U.S. Department of Energy and the National Nuclear Security Administration’s attempt to suppress a lawsuit seeking a comprehensive environmental review of the agencies’ plans to produce large quantities of nuclear bomb cores, or plutonium pits, at DOE sites in New Mexico and South Carolina.
Expanded Plutonium “Pit” Bomb Production Rules Over Genuine Cleanup Los Alamos Lab Plans to Make Existing Nuclear Waste Dumps Permanent Without Eliminating Threat to Groundwater
The Department of Energy (DOE) has submitted a report to the New Mexico Environment Department (NMED) declaring its preferred plan to “cap and cover” radioactive and toxic wastes at one of the Los Alamos National Laboratory’s (LANL’s) oldest dumps. DOE’s $12 million cleanup-on-the-cheap plan for Material Disposal Area C will create a permanent nuclear waste dump above our regional groundwater. In contrast, DOE has asked Congress for one billion dollars for expanded plutonium “pit” bomb core production at LANL for fiscal year 2022 alone.
LANL used to falsely claim that groundwater contamination was impossible and even asked NMED for a waiver from even having to monitor for it. We now know that there is extensive groundwater contamination from hexavalent chromium (the carcinogen in the Erin Brockovich movie) and high explosives. Traces of plutonium have been detected 1,300 feet under Area C in regional groundwater monitoring wells. The dump also has a large toxic gaseous plume of industrial solvents known as volatile organic compounds (VOCs) which threatens nearby facilities.
New Mexico: Number One in Nuclear Weapons and Radioactive Wastes Near Last in Citizen and Child Well-Being
The goal of NNSA programs in New Mexico is to indefinitely extend the service lives of existing nuclear weapons while giving them new military capabilities. This will be followed by completely new nuclear weapons that cannot be tested given the global testing moratorium. Alternatively, it could prompt the U.S. back into nuclear weapons testing, which would have serious international proliferation implications. NNSA’s claimed rationale is “deterrence” which requires only a few hundred nuclear weapons. In reality the U.S. and Russia each have thousands of ready-to-launch weapons for nuclear war-fighting.
Lawsuit Filed Against Biden Administration Over Nuclear Bomb Core Production Plans
Federal agencies’ refusal to review cross-country expansion of plutonium pit production violates the National Environmental Policy Act and the Administrative Procedures Act, groups say.
AIKEN, S.C. – Today, a coalition of community and public interest groups filed a lawsuit against the U.S. Department of Energy (DOE) and the National Nuclear Security Administration (NNSA). This legal action is prompted by the agencies’ failure to take the “hard look” required by the National Environmental Policy Act at their plans to more than quadruple the production of plutonium pits and split their production between the Los Alamos National Laboratory in New Mexico and the Savannah River Site in South Carolina.

Santa Fe, NM – The Biden Administration has finally released budget details for Department of Energy (DOE) programs that clean up Cold War contamination and radioactive and toxic wastes. In January the New Mexico Environment Department sued DOE in order to terminate a 2016 “Consent Order” that subordinated cleanup at the Los Alamos National Laboratory (LANL) to the budget that DOE wants, which is increased nuclear weapons production. The Biden Administration has responded by increasing proposed cleanup funding at the Lab by 33% from $226 million in FY 2021 to $333.5 million proposed for FY 2022 (which begins October 1, 2021).

Santa Fe, NM – In a classic move that discouraged media coverage, the Department of Energy’s semi-autonomous National Nuclear Security Administration (NNSA) released its long delayed FY 2022 Congressional Budget Request around 7:30 pm EST Friday, May 28, at the very beginning of the long Memorial Day weekend.
Nuclear Watch New Mexico strongly opposed the 25% FY 2021 increase that the Trump Administration bequeathed to NNSA’s nuclear weapons programs. That massive increase was originally sold in testimony to Congress as essential to maintaining the nuclear deterrence but later revealed as necessary to cover NNSA cost overruns and blown schedules.[i]

Non-Governmental Organizations Demand Resumption of Los Alamos Nuclear Bomb Plant Public Information Meetings
The NGOs request that the semi-annual public meetings resume by early fall 2020, and the CMRR Project website be updated and maintained until the RLUOB reconfiguration and PF-4 upgrades are completed. All documents and presentations from the previous 13 public meetings must be reposted. The NGOs are also asking that the unilateral decision by the DOE/National Nuclear Security Administration (NNSA) to increase the amount of plutonium equivalent allowed in the RLUOB from 8.4 grams to 400 grams be reviewed by NMED.

Final conference by Senate and House Armed Services Committee deleted expansion of the Radiation Exposure Compensation Act that would have covered Trinity Test Downwinders, among others. In contrast, it authorized tens of billions for expanding nuclear weapons programs. So, it’s nothing for those harmed by nuclear weapons testing and production in New Mexico, but radical expansion of those programs that did harm them.
The FY 2024 Defense Authorization Act added money above Biden’s request for pit production at the Savannah River Site and the Sea-Launched Cruise Missile and its new nuclear warhead. The Biden Administration opposed the SLCM, but Congress authorized it anyway.
LANL SWEIS
The 2020 Supplement Analysis that we had robustly critiqued with comprehensive formal comments, which DOE/NNSA have ignored, contains analysis of pit production based solely off the 2008 SWEIS pit analysis. Our single biggest point in the 2020 SA comments was the need for a programmatic environmental impact statement on expanded plutonium pit production.
Homily and Statement by Archbishop Wester to the Parties to the Treaty on the Prohibition of Nuclear Weapons
On November 29, 2023, the 34th anniversary of the death of Dorothy Day, and in conjunction with the Second Meeting of the State Parties to the Treaty on the Prohibition of Nuclear Weapons, the Archbishop of Santa Fe John C. Wester gave a homily on nuclear disarmament at Our Church of the Savior near the United Nations. Dorothy Day was a life-long anti-nuclear weapons activist and is now being considered for canonization by the Catholic Church.
The Second Meeting of States Parties on the Prohibition of Nuclear Weapons
Since the invasion of Ukraine nearly two years ago, to the recent situation in Israel/Gaza, the risk of impending nuclear war has been a reality considered by many for the first time. As stated at a side event during the weeklong meeting of States Parties on the Prohibition of Nuclear Weapons (TPNW) held last week from November 27 to Decmber 1st, Hirotsugu Terasaki, Director General of Peace and Global Issues, Soka Gakkai International (SGI), warned that the wide-scale violence brought by these two events “continue to heighten the risk that nuclear weapons could actually be used.” This fear is made all the more tangible when considering also that earlier this month, the Putin announced Russia would be revoking its ratification of the Comprehensive Test Ban Treaty (CTBT), which Terasaki pointed out is a “serious setback for the cause of nuclear disarmament.”
As stated in the article, The Voices of Victims of Nuclear Weapons Testing, “these realities make convening the current Second Meeting of States Parties of the TPNW, which concludes December 1, all the more important and a crucial opportunity to revive momentum for nuclear disarmament and abolition.”

New bomb: The Pentagon has announced a new nuclear bomb, the B61-13. The B61-12 is now in production and will be forward deployed in Europe. But it has a dial-a-yield that maxes out at 50 kilotons. The new B61-13 will max out at 360 kt to get at hardened deeply buried targets (both have limited earth-penetrating capabilities). At one time, production of the B61-12 at least potentially signified retirement of the 1.2 megaton surface burst B83 strategic bomb, but now production of the B61-13 will probably be relatively quick at the tail end of already scheduled B61-12 production.

Strategic Posture Review: Commissioned by Congress,

The Commission recommends that once a strategy and its related force requirements are established, the U.S. government determine whether and how nuclear arms control limits continue to enhance U.S. security…”

U.S. Strategic Posture Commission Ratchets Up Nuclear Arms Race
Today, America’s Strategic Posture, The Final Report was released by the Congressional Commission on the Strategic Posture of the United States. In its own words:
“The Congressional Commission on the Strategic Posture of the United States was established by the Fiscal Year (FY) 2022 National Defense Authorization Act (NDAA), and concludes that America’s defense strategy and strategic posture must change in order to properly defend its vital interests and improve strategic stability with China and Russia. Decisions need to be made now in order for the nation to be prepared to address the threats from these two nuclear-armed adversaries arising during the 2027-2035 timeframe. Moreover, these threats are such that the United States and its Allies and partners must be ready to deter and defeat both adversaries simultaneously.”
The United States has already embarked upon a $2 trillion “modernization” program that is a complete makeover of its nuclear forces. This program will rebuild every warhead in the planned future stockpile while giving them new military capabilities. It will also build new-design nuclear weapons and new missiles, subs and bombers to deliver them, plus new nuclear weapons production plants expected to be operational until the 2080’s.
Los Alamos Lab’s Future at a Crossroads: Cleanup or More Nuclear Weapons? NukeWatch Applauds NM State Rejection of Fake Cleanup
Santa Fe, NM – In an important win for genuine cleanup at the Los Alamos National Laboratory (LANL), the New Mexico Environment Department (NMED) has rejected the Lab’s plans for so-called cleanup through “cap and cover.” LANL’s plan would leave existing radioactive and toxic wastes uncharacterized and forever buried in unlined pits and trenches as a permanent threat to groundwater. At issue is remediation of the Lab’s “Material Disposal Area C” waste dump that has 7 pits and 108 shafts of radioactive and toxic wastes. Area C is located in the heart of nuclear weapons production at LANL, contiguous to the Lab’s main plutonium facility which is expanding production of plutonium “pit” bomb cores.
In a September 7, 2023 “Public Notice of Statement of Basis,” the Environment Department ruled:
“For maximum protection of human health and the environment and to ensure that the drinking water resource can be conservatively protected, NMED has determined that the selected [cleanup] remedy for MDA C must consist of waste excavation, characterization, and appropriate disposal of the buried waste… Excavation will ensure that the source of contamination at MDA C is removed…”
National Nuclear Security Administration: New Assessments of Major Projects from the Government Accountability Office
National Nuclear Security Administration: Assessments of Major Projects
The National Nuclear Security Administration plans to invest over $30 billion in its major projects to modernize the research and production infrastructure supporting the nation’s nuclear weapons stockpile. This is our first biennial assessment of NNSA’s major projects.
As of March 2023, NNSA’s major projects collectively exceeded their cost estimates by over $2 billion. They also surpassed their collective schedules by almost 10 years. Cost growth and schedule delays had multiple causes, such as lower levels of worker productivity than planned.
The Department of Energy has been on the Government Accountability Office’s “High Risk List” for project mismanagement since 1991. A January 2023 GAO report says it all: NNSA Does Not Have a Comprehensive Schedule or Cost Estimate for Pit Production Capability. Congress has made its ongoing concern over the lack of pit aging studies explicit in legislation. The FY 2021 Consolidated Appropriations Act enacted the following provision:
“Pit and Plutonium Aging.-There is concern with the apparent lack of focus on advancing knowledge regarding pit and plutonium aging since the JASONs conducted its first study in 2006. Given the future needs of the nation’s nuclear deterrent, a robust program of research and experimentation is needed. Therefore, NNSA is directed to develop a comprehensive, integrated ten-year research program for pit and plutonium aging that represents a consensus program among the national laboratories and federal sponsors. Such a plan shall include estimated cost of ongoing research, new or upgraded capability needs, and key near-, mid-, and long-range milestones. The plan shall be submitted to the Committees on Appropriations of both Houses of Congress not later than 180 days after enactment of this Act.”
As far as is publicly known no such plan has been submitted to Congress despite its statutory requirement. That said, a ten year plan to have plutonium pit aging studies is not sufficient to begin with when uncertainty over pit aging is being used as the rationale for an aggressive plutonium pit production program costing at least $60 billion over the next thirty years. The recent GAO report states, “…Six projects in the design phase are implementing significant changes that may increase their cost and schedule beyond NNSA’s preliminary estimates. These include a project to modify existing plutonium processing facilities at Los Alamos National Laboratory in New Mexico.”
Furthermore, the entire U.S. $2 Trillion “Modernization” plan includes new intercontinental ballistic missiles, new cruise missiles, heavy stealth bombers and
submarines, which entails rebuilding warheads with new military capabilities plus completely new-design nuclear weapons. This is not just for “deterrence” but instead for nuclear warfighting capabilities. No production of plutonium pits is scheduled to maintain the safety and reliability of the existing nuclear stockpile; instead it is for new-design nuclear weapons. The US is inspiring a new arms race with nuclear weapons forever.

Three Huge New Facilities Rebuild U.S. Nuclear Weapons Production Capacity
Modern nuclear weapons are comprised of three general types of components: plutonium pit primaries, uranium/lithium secondaries that are triggered by the primaries, and the 1,000’s of non-nuclear components that create deliverable weapons of mass destruction (fuzes, radar, bomb cases, etc.). The U.S. is aggressively pursuing major new production facilities for all three types. At the Los Alamos National Laboratory (LANL) in New Mexico, the “Chemistry and Metallurgy Research Replacement (CMRR) Project” will be the keystone to a revived plutonium manufacturing complex. The proposed “Uranium Processing Facility” (UPF) at the Y-12 Site in Oak Ridge, Tennessee, will be the future production plant for warhead secondaries. A new “Kansas City Plant” (KCP) in Missouri for nonnuclear components production is slated for groundbreaking in August 2010. Each of these three major new production facilities is expected to operate for the next half-century, in sharp contradiction to the declared national and global security goal of a nuclear weapons-free world.
A Compromised START
Nuclear Watch New Mexico is a staunch supporter of arms control treaties, particularly since they can be confidence building steps toward the long term goal of creating the nuclear weapons-free world articulated by President Obama.
However, we fear that arms control treaties will be turned on their heads to become in effect armament treaties for the American nuclear weapons complex. We think our fears are now concretely realized by the Obama Administration’s “modernization plan” attached to yesterday’s submittal of New START to the Senate for ratification.
As you probably know, the Obama plan is to increase funding for the NNSA’s nuclear weapons programs from $6.4 billion in FY10 to $9 billion by FY 2018, which is a 76% increase above the Cold War annual average of $5.1 billion. We think that is obviously a serious step backwards on the road to a nuclear weapons-free world, especially when the labs seem intent on introducing new military capabilities to existing types of U.S. nuclear weapons.
There have been calls for unconditional public support of New START. Yet current political realities are that New START will be heavily conditioned by both the Obama Administration and the Senate to include the revitalization of the U.S. nuclear weapons complex.
In concrete terms, this means dramatically increased funding for huge new production plants for plutonium, uranium and nonnuclear components, respectively the Los Alamos CMRR-Nuclear Facility, the Y-12 Uranium Processing Facility and the new Kansas City Plant.
It also means future aggressive Life Extension Programs that will substantially modify the nuclear explosives package, a serious threshold that we have not yet crossed (and which could effectively recreate the Reliable Replacement Warheads that NNSA sought but Congress rejected, but by another name). We also need to remain aware of the failure to ratify the Comprehensive Test Ban Treaty in 1999, but which nevertheless profited the nuclear weapons labs and complex by some $100 billion to date under the Stockpile Stewardship Program to compensate for the loss of underground full-scale testing.
We don’t question that appeals for public support of New START should go forward. But as NGOs we are also entrusted with public responsibility to provide a fuller picture.
We argue that certain conditions for New START ratification, such as increased funding for new production facilities, LEPs and stockpile work, should be publicly explained, and lead to qualified instead of unconditional support of New START ratification.
Obama Bails Out Arms Reduction Treaty by Dramatically Increasing Nuclear Weapons Budgets
Santa Fe, NM – Yesterday President Obama submitted the new bilateral Strategic Arms Reduction Treaty (START) with Russia to the Senate for ratification. At the same time he submitted a modernization plan required by Congress that “includes investments of $80 billion to sustain and modernize the [U.S.] nuclear weapons complex over the next decade.” Given that two-thirds of the Senate is required for treaty ratifications a large political fight was always expected over a second attempt at ratifying the previously rejected Comprehensive Test Ban Treaty (CTBT). However, last December all 40 Republican senators plus one independent wrote to President Obama demanding modernization of both the stockpile and complex as a condition for New START ratification. Meanwhile, the prospects for ratification of the CTBT (first proposed by Prime Minister Nehru of India in 1954) look increasingly dim.
In response to Republican demands, the Obama Administration plans to increase funding for the nuclear weapons research and production programs of the National Nuclear Security Administration (NNSA) by more than 40% from $6.4 billion in FY 2010 to $9 billion by 2018. In turn, $9 billion is 43% above the average annual cost of $5.1 billion during the Cold War for analogous Department of Energy nuclear weapons programs.

U.S. nuclear weapons will undergo extensive life extension programs in the coming years to ensure their safety, security and effectiveness. Maintaining a credible nuclear deterrent requires that the United States operates a modern physical infrastructure and sustain a highly capable workforce.
That may seem intuitively logical on the face of it, but NNSA and the nuclear weapons labs are subtly changing the frame of debate to favor their own interests. Independent scientists have repeatedly found that the nuclear weapons stockpile is safe and reliable and can be so maintained by existing life extension programs. Past NNSA budget requests repeatedly invoke a “reliable” stockpile, but its FY 2011 request is full of references to an “effective” stockpile.
NNSA Administrator Tom D’Agostino claimed at a recent presentation to international delegations at the United Nations for the NonProliferation Treaty Review Conference that the U.S. is meeting its disarmament obligations in good faith. At the same time, he repeatedly stated the U.S.’s need to maintain an “effective” stockpile. When asked what effective meant he replied it meant having confidence in the nuclear weapons stockpile underpinned by the right mix of infrastructure and people.
In order to extract increased funding, NNSA and the nuclear weapons labs are trying to shift the debate over maintaining the stockpile from technical arguments over warhead safety and reliability to subjective arguments over maintaining an exorbitant research and production complex and workforce. This will not only cost enormous sums of money, which is what the labs seek, but will also perversely undermine confidence in the stockpile because of planned changes, including new military capabilities, that will be made to existing, previously tested weapons. Giving the nuclear weapons labs a blank check contradicts Obama’s declared national security goal of a future nuclear weapons-free world. Instead, he should be redirecting the labs into dramatically increased nonproliferation programs, cleanup, and meeting today’s national security threats of nuclear terrorism, energy dependence and climate change.

Of particular interest are cited Los Alamos Lab viewgraphs that state “Technically: there is little difference between a ratified CTBT, and the current testing moratorium” and “There are several ways to sustain capabilities… Get more money.” The point is that the nuclear weapons labs are fully aware that treaty ratifications are an opportunity for them to secure more funding, as they did in the build up to the 1999 ratification process that rejected the CTBT.
A Tale of Two Cross-Sections
At the recent LANL Hazardous Waste Permit Hearings, the public was presented with two cross-sections of the current understanding of the geology under the Lab’s largest nuclear waste disposal area, Tech Area 54. These cross sections are important because the NM Environment Department, with public input, will soon have to decide the final disposition of the over 800,000 cubic yards of radioactive and hazardous waste buried there. The options range from leaving the waste in place with some sort of cover to exhuming the waste.
The geology under the site is very complicated and includes layers of lava flows, ash falls, and old stream beds. The waste is buried in unlined pits, shafts and trenches and is perched 800 – 1000 feet above our sole-source aquifer. Some of the more soluble contaminants, such as tritium, perchlorate, explosives, and chromium have already made their way to the aquifer from other parts of the Lab. The cross-sections are needed to understand the contaminant pathways from the dumps to the aquifer.

The MDAs, or Material Disposal Areas or dumps, are across the top. MDA G is the largest by far. The PM-#s are wells where drinking water is drawn. The R-#s are characterization and contaminant sampling wells. The elevation is on each side. The top of the regional aquifer is the horizontal blue line near 5800′. There are some perched aquifers shown, too. The one question is a new structure that the Lab is calling a “dike” discovered by well R-22.

The Environment Department’s version gives a different interpretation of the fractures that could be pathways to the aquifer. It has many question marks, including the “vent” and the perched aquifers.
We appreciate the two versions. With so many unknowns, with so much waste, and with such a potential negative impact to our aquifer, the most protective course would be to remove the waste.
New Nuclear Facility – An Attempt to Divide and Conquer

I’m in New York City for the first week of the Non-Proliferation Treaty Review Conference that opened today (Monday May 3). Yesterday global citizens marched from Times Square to the United Nations demanding nuclear weapons abolition. I was very moved to see ~10,000 people from ~25 countries pour into this little park across from the UN, where NukeWatch and some 40 other organizations had information waiting for them.
My main gig here is about the 3 proposed huge nuclear weapons production plants the U.S. is planning to spend some $10 billion on over the next decade. They are the “Nuclear Facility” that will keystone an expanded plutonium complex at Los Alamos; the Uranium Processing Facility (UPF) at the Y-12 Site near Oak Ridge, TN; and the new Kansas City Plant (KCP). These facilities will expand production capability up to 80 new warheads per year. For more, see New US Production Facilities.
When I talked to folks (half from other countries) here for the Conference about these new facilities, most invariably say, “But, but, buuuuuuuut… what about Obama?” Their eyes get big when I tell them Obama doubled FY 2011 funding for the Nuclear Facility and UPF (KCP is privately financed, hence outside the federal budget). I guess they heard the part loud and clear from Obama in Prague about a nuclear weapons-free world, but not so much when he said probably not in my lifetime.
If left just up to him, I suppose that would be the case, given that these production facilities are expected to operate until 2065. But at least there are ~10,000 global citizens here in NYC pushing for sooner than that. We’ll see what concrete results the NPT Review Conference brings.
The CMRR-Nuclear Facility Is All About Expanding Plutonium Pit Production Capacity
In response to a question by Senator Jeff Bingaman at a Senate Armed Services Committee hearing on April 14, 2010, NNSA Administrator Tom D’Agostino stated “We will not make pits in the CMR replacement facility. We’ll make them in the existing older facility.”
That is narrowly true, but highly misleading. In fact, the Chemistry and Metallurgy Research Replacement (CMRR) Project is all about expanding plutonium pit production capabilities at the Los Alamos National Laboratory from the presently sanctioned level of 20 per year to up to 80. [Plutonium pits are the fissile “triggers” that initiate fusion in today’s modern thermonuclear weapons.] Yes, PF-4, LANL’s existing plutonium facility, performs the actual physical manufacturing of pits. However, that production cannot take place without “analytical chemistry” (AC) and “materials characterization” (MC) before production to make sure that the plutonium is weapons-grade, and extensive AC and MC sampling during production for stringent “war reserve” quality control.
It’s a mistake to get hung up on different facilities, when an integrated plutonium complex for expanded pit production capability is being created through proposed construction of the CMRR’s “Nuclear Facility” and upgrades to PF-4. It’s silly to think of them as separate facilities just because they’ll be under two different roofs. PF-4 and the Nuclear Facility will be next door to each other, linked by underground tunnel, with highly integrated operations and much exchange of special nuclear materials between them (especially given the Nuclear Facility’s planned vault for up to six metric tons of “special nuclear materials”).
The CMRR Nuclear Facility is being specifically sized to support pit production capability of 50 – 80 pits per year. An internal NNSA study of planned alternatives advocated for a “baseline version (22,500 ft2 of Pu lab space) of the CMRR-NF…, resulting in a production capacity of 50-80 ppy” [pits per year]. Independent Business Case Analysis of Consolidation Options for the Defense Programs SNM and Weapons Programs, TechSource, Inc, December 2007, p. 5-3, parentheses in the original. This “Business Case” is one of NNSA’s hundreds of reference documents for its 2008 Complex Transformation Supplemental Programmatic Environmental Impact Statement. That 22,500 ft2 of Pu lab space is exactly what is being designed for the Nuclear Facility now. “CMRR Project Nuclear Facility… Baseline under development …. 22,500 Net Square Feet Lab Space.” CMRR Project Update, LANL, Public Meeting, Los Alamos, New Mexico March 3, 2010, 7th viewgraph.
Los Alamos National Security, LLC, the for-profit corporation that runs Los Alamos, has already been paid for installing additional equipment in PF-4 that in conjunction with the future CMRR-Nuclear Facility will expand plutonium pit production capability to up to 80 pits per year. “Build Six New W88 Pits & Install Equipment in FY 2008 to Increase Pit Capacity to 80 Pits Per Year by the Operational Date of a CMRR-Nuclear Facility – Available Fee $1,079,915 – Awarded Fee $1,079,915.” FY 2008 Performance Evaluation Report for the Los Alamos National Security, LLC’s Management and Operation of the Los Alamos National Laboratory, NNSA, p. 9.
NNSA echoes this in its FY 2010 Supplemental Stockpile Stewardship Plan. Under Key Recent Accomplishments the agency boasts of “New equipment installed as scheduled for gradual capacity increases to 80 pits per year potential by scheduled operational date for Chemistry and Metallurgy Research Replacement (CMRR) Nuclear Facility.” Table 1-1, NNSA/Office of Defense Programs, FY 2010 – 2014 Supplement to the Stockpile Stewardship Plan, p. 14.
In sum, suggestions or representations by NNSA and LANL that the $4.5 billion CMRR Project is not about pit production are at best half-truths. Its massive proposed “Nuclear Facility” is, in fact, all about expanded pit production capability.
What the New Definition of “New” Is
On March 16 I met with a senior congressional staff members. I raised the issue of what is “new.” I specifically pointed to an earth-penetrating variant of the B61 gravity bomb (the B61-11) that was rushed to the stockpile in 1997, likely because of a perceived threat of an alleged Libyan hardened underground bioweapons facility. B61’s are believed to have selectable yields, ranging from .3 kilotons to 300 kilotons.
The destructive effects of earth-penetrating weapons (even if they penetrate 10 meters or less) rise exponentially due to shock “coupling” with geologic strata. The B61-11, with a yield of up to 300kt, was designed to and did replace the monster 9-megaton surface-burst B53. Earth-penetration is indisputably a new military capability for the B61 bomb. But because the B61-11 has the same military mission as the B53 to destroy hardened deeply buried targets (never mind the extreme differences in yields, while arguably lower yield weapons are more “usable”), this senior HASC staffer asserted that the B61-11 was not a “new” nuclear weapon.
This is not an isolated case. I then went on to raise the current example of the sub-launched W76 that is now being refurbished in an ongoing Life Extension Program (LEP). It is being endowed with a new fuze that gives it selectable heights of burst and a more accurately targetable reentry vehicle. So it not only can hit a smaller target, but the lower the altitude of the burst, the more it can hold hardened bunkers or underground facilities at risk. Pete Nanos, then head of Naval Strategic Systems (and later controversial LANL Director), wrote in 1997 that the refurbished 100kt W76-1Mk4 would be transformed into a hard target killer, one that is a “counterforce” weapon against military assets rather a “countervalue” (“city-buster”) weapon of deterrence.
But because refurbished W76s could replace the hard target killer mission of 450kt. sub-launched W88s, this HASC staffer again maintained that it was not a “new” weapon. Never mind that there are less than an estimated 400 W88s, while the Bush Administration planned to run some 2,000 W76’s through LEP’s, which would radically alter the strategic equation (we don’t yet know how many Obama will refurbish).
To add to my case, now Under Secretary for Arms Control and Nonproliferation Ellen Tauscher (former congresswoman for the CA district that sites Livermore Lab) has also indicated that if a modified existing U.S. nuclear weapon, no matter how profoundly changed, assumes the mission of another existing nuclear weapon, then it is not a “new” nuclear weapon.
Needless to say the specific missions of U.S. nuclear weapons are highly classified. But the bottom line is that our stockpile is enough to kill this planet many times over. The U.S. Government appears poised to run many existing nuclear weapons through extreme makeovers (including plutonium pit triggers) that clearly give them new military capabilities. But because there is little theoretical end to what nuclear weapons can blow up (on this planet anyway) our government will continue to deny that these heavily modified existing nuclear weapons are “new” nuclear weapons as long as they assume the missions of other existing nuclear weapons.
In other words, they think they can do whatever they damn well please, and still not call it a new nuclear weapon.

The question arose at the Alliance for Nuclear Accountability meeting this week over the potential level of future pit production at LANL and the role that the Chemistry and Metallurgy Research Replacement Project – Nuclear Facility will play in it.

Senator Bingaman Supports More Nuclear Plants
In the January/February issue of Mother Jones magazine Mariah Blake writes that New Mexico’s Senator Bingaman aided by Lisa Murkowski (R, Alaska) has introduced legislation likely to be included in the coming climate bill that would create a Clean Energy Development Agency (CEDA) within DOE with authority to extend a ‘virtually unlimited number of loan guarantees—without congressional review—to utilities to build nuclear plants.’ Blake goes on to say that both Bingaman and Mirkowski are ‘top recipients of the nuclear industry’s campaign largesse.’ Interested utilities would have to pay an unspecified fee to get a loan guarantee but, if the historical default rate from the 1st generation of US nuclear power folly is a guide, these fees will not come close to covering defaults. Blake continues: “According to the Union of Concerned Scientists, if 100 new plants are built, as key Republican lawmakers have called for, the price of bad loans could total at least $360 billion—and that’s assuming zero cost overruns.”
So if fellow New Mexicans do not want MORE federal subsidies wasted in nuclear power plant construction they should send a ‘boo and hiss’ email to Senator Bingaman. I had not realized how completely Jeff had donned the pro-nuke mantle of Pete Domenici—and I deplore it!

Read/Download the Full Press Release HERE May 31, 2019 Press Release Last Wednesday, facility operations personnel entered a service room and noticed a leak emanating from a valve on the radioactive liquid waste (RLW) system. Upon subsequent visual inspection by a radiological control technician, RLUOB engineers believe that this valve, and 6 similar valves, may be constructed of carbon steel. The RLW system handles radioactive liquid waste streams from chemistry operations that include nitric and hydrochloric acids—carbon steel valves would be incompatible with these solutions. The suspect valves are also in contact with stainless steel piping, which would create another corrosion mechanism. RLUOB management plans to drain the affected piping sections and develop a work package to replace all of the suspect valves. They will also confirm the valve materials and if shown to be incorrect, investigate the cause of this failure in the design, procurement, and installation processes. The valves were installed in 2013 as part of a modification to add straining and sampling capabilities that were not in the included in the original design. [Please note that DNFSB reports are posted a few weeks later than dated.] This immediately raises two crucial issues: 1) the National Nuclear Security Administration’s (NNSA’s) plans for expanded plutonium pit production; and 2) the current attempt by the Department of Energy to restrict Safety Board access to its nuclear weapons facilities. November 16, 2018 Plutonium Pit Production Fact Sheet Plutonium pits are the radioactive cores or “triggers” of nuclear weapons. Their production has always been a chokepoint of resumed industrial-scale U.S. nuclear weapons production ever since a 1989 FBI raid investigating environmental crimes shut down the Rocky Flats Plant near Denver. In 1997 the mission of plutonium pit production was officially transferred to its birthplace, the Los Alamos National Laboratory (LANL) in northern New Mexico, but officially capped at not more than 20 pits per year. However, in 2015 Congress required expanded pit production by 2030 whether or not the existing nuclear weapons stockpile actually needs it. This will support new military capabilities for nuclear weapons and their potential use. She in turn accused the nonprofit group Northern New Mexico Protects of political motivations in revealing these questionable expenses. Romero is running in the Democrat Party primary against incumbent state Rep. Carl Trujillo for Santa Fe County's 46th district in the state House of Representatives. On December 17, 2017, the Department of Energy (DOE) awarded a separate $1.4 billion contract for cleanup at the Los Alamos National Laboratory (LANL) to Newport News Nuclear BWXT-Los Alamos, LLC (also known as "N3B"). This award followed a DOE decision to pull cleanup from LANL's prime contractor, Los Alamos National Security, LLC (LANS), after it sent an improperly prepared radioactive waste drum that ruptured underground at the Waste Isolation Pilot Plant (WIPP). That incident contaminated 21 workers and closed WIPP for nearly three years, costing taxpayers at least $1.5 billion to reopen. The Congressional Budget Office estimates that the most recent detailed plans for nuclear forces, which were incorporated in the Obama Administration's 2017 budget request, would cost $1.2 trillion in 2017 dollars over the 2017-2046 period: more than $800 billion to operate and sustain (that is, incrementally upgrade) nuclear forces and about $400 billion to modernize them.... Driving this astronomical expense is the fact that instead of maintaining just the few hundred warheads needed for the publicly claimed policy of "deterrence," thousands of warheads are being refurbished and improved to fight a potential nuclear war. Nuclear Watch argues that expanded plutonium pit production could actually have negative effect if it blocks other economic alternatives such as comprehensive cleanup, which could be the real job producer. Moreover, given LANL's poor safety and environmental record, expanded plutonium pit production could have a seriously negative economic impact on northern New Mexico in the event of any major accidents. The Los Alamos National Laboratory (LANL) has detected far more hexavalent chromium (Cr) contamination than previously estimated in the "sole source" regional groundwater aquifer that serves Los Alamos, Santa Fe and the Espanola Basin. January 5, 2017 Press Release The National Nuclear Security Administration (NNSA) has publicly released its fiscal year 2016 Performance Evaluation Report (PER) for Los Alamos National Security, LLC (LANS), the for-profit contractor that runs the Los Alamos Lab. The Performance Evaluation Report is NNSA's annual report card on contractor performance, and overall the agency awarded LANS $59 million in profit out of a possible $65 million. The grade was 85% for the incentive part of the award. In 2012 Nuclear Watch New Mexico successfully sued NNSA to ensure that the Performance Evaluation Reports detailing taxpayers funds paid to nuclear weapons contractors are publicly available. In 2016 the NNSA decided to put the LANL management contract out for competitive bid, but granted LANS a contract extension until the end of September 2018. |
