Court Rules U.S. Nuclear Weapons Production Plan Violates Federal Law

AIKEN, S.C. — On September 30, United States District Court Judge Mary Geiger Lewis ruled that the United States Department of Energy (“DOE”) and its semi-autonomous nuclear weapons agency, the National Nuclear Security Administration (“NNSA”), violated the National Environmental Policy Act (“NEPA”) by failing to properly consider alternatives before proceeding with their plan to produce plutonium pits, a critical component of nuclear weapons, at the Los Alamos National Laboratory (“LANL”) in New Mexico and, for the first time ever, at the Savannah River Site (“SRS”) in South Carolina.

The Court found that the plan’s purpose had fundamentally changed from NNSA’s earlier analyses which had not considered simultaneous pit production at two sites.  These changes necessitated a reevaluation of alternatives, including site alternatives, which Defendants failed to undertake prior to moving forward while spending tens of billions of taxpayers’ dollars. Therefore, the Court entered judgment in favor of Plaintiffs, the nonprofit public interest groups Savannah River Site Watch, Nuclear Water New Mexico and Tri-Valley Communities Against a Radioactive Environment (CAREs); the Gullah/Geechee Sea Island Coalition; and Tom Clements as an individual plaintiff.

As a result of this ruling, the Defendants are required to newly assess pit production at a nation-wide programmatic level which will mean undertaking a thorough analysis of the impacts of pit production at DOE sites throughout the United States, including radioactive waste generation and disposal. Under the National Environmental Policy Act (NEPA), this will provide the opportunity for public scrutiny of and formal comment on their assessments.

Santa Fe, NM – In April Nuclear Watch New Mexico released a map of plutonium contamination based on Lab data. Today, Dr. Michael Ketterer, Professor Emeritus of Chemistry and Biochemistry, Northern Arizona University, is releasing alarmingly high results from samples taken from a popular walking trail in the Los Alamos Town Site, including detections of some of the earliest plutonium produced by humankind.

On July 2 and 17 Dr. Ketterer, with the assistance of Nuclear Watch New Mexico, collected water, soil and plant samples from Acid Canyon in the Los Alamos Town Site and soil and plant samples in Los Alamos Canyon at the Totavi gas station downstream from the Lab. The samples were prepared and analyzed by mass spectrometry at Northern Arizona University to measure concentrations of plutonium, and to ascertain its sources in the environment.

Nearly three years after filing a Freedom of Information Act request, the public interest group Savannah River Site Watch has finally received the National Nuclear Security Administration’s (NNSA’s) congressionally-required “Research Program Plan for Plutonium and Pit Aging.” However, the document is 40% blacked out, including references and acronyms. Plutonium “pits” are the radioactive cores of all U.S. nuclear weapons. The NNSA claims that potential aging effects are justification for a ~$60 billion program to expand production. However, the Plan fails to show that aging is a current problem. To the contrary, it demonstrates that NNSA is delaying urgently needed updated plutonium pit aging research.

In 2006 independent scientific experts known as the JASONs concluded that plutonium pits last at least 85 years without specifying an end date [i] (the average pit age is now around 40 years). A 2012 follow-on study by the Lawrence Livermore nuclear weapons lab concluded:

“This continuing work shows that no unexpected aging issues are appearing in plutonium that has been accelerated to an equivalent of ~ 150 years of age. The results of this work are consistent with, and further reinforce, the Department of Energy Record of Decision to pursue a limited pit manufacturing capability in existing and planned facilities at Los Alamos instead of constructing a new, very large pit manufacturing facility…” [ii]

Since then NNSA has reversed itself. In 2018 the agency decided to pursue the simultaneous production of at least 30 pits per year at the Los Alamos National Laboratory (LANL) in northern New Mexico and at least 50 pits per year at the Savannah River Site (SRS) in South Carolina. Upgrades to plutonium facilities at LANL are slated to cost $8 billion over the next 5 years. The redundant Savannah River Plutonium Processing Facility in South Carolina will cost up to $25 billion, making it the second most expensive building in human history.

Santa Fe, NM – Ironically the day after the film Oppenheimer was awarded multiple Oscars, the Department of Energy’s semi-autonomous National Nuclear Security Administration (NNSA) asked Congress for its biggest nuclear weapons budget ever. NNSA’s FY 2025 request for “Total Weapons Activities” is $19.8 billion, $700 million above what Congress recently enacted for FY 2024. It is also a full billion dollars above what President Biden asked for last year, which Congress then added to and will likely do so again.

The Biden Administration states that the $19.8 billion will be used to:

“[P]rioritize implementation of the 2022 National Defense Strategy and Nuclear Posture Review by modernizing the Nation’s nuclear deterrent to keep the American people safe. The Budget supports a safe, secure, reliable, and effective nuclear stockpile and a resilient, responsive nuclear security enterprise necessary to protect the U.S. homeland and allies from growing international threats.” whitehouse.gov/wp-content/uploads/2024/03/budget_fy2025.pdf, page 75.

The 2022 National Defense Strategy and Nuclear Posture Review for the first time posited two nuclear “near peers”, i.e. Russia and China, that need to be simultaneously “deterred.” This hinted at a potentially large nuclear buildup which this budget may now be implementing. That claimed need to deter two nuclear near peers was explicitly taken a step beyond just deterrence in an October 2023 report from the Strategic Posture Commission. It declared:

“Decisions need to be made now in order for the nation to be prepared to address the threats from these two nuclear-armed adversaries arising during the 2027-2035 timeframe. NNSA Suppresses How Taxpayers Money Is Spent

Santa Fe, NM – The National Nuclear Security Administration (NNSA) has just released cursory two or three page summaries of contractors’ performance paid for by the American taxpayer. For the just ended fiscal year 2023, NNSA gave nothing less than grades of “Excellent” or “Very Good” in six broad mission goals for its major contractors. This is despite the constant cost overruns and schedule delays that are the rule, not the exception, in the nation-wide nuclear weapons complex. NNSA and its parent Department of Energy have been on the Government Accountability Office’s “High Risk List” for project mismanagement ever since GAO started that List in 1991.

NNSA Suppresses How Taxpayers Money Is SpentA current example is the Uranium Processing Facility (UPF) at the Y-12 Plant near Oak Ridge, Tennessee, originally estimated in 2011 to cost $1.4 to $3.5 billion. After costs started going through the roof, NNSA and Senator Lamar Alexander (R.-TN), then-chair of Senate Energy and Water Appropriations, swore that UPF would never go over $6.5 billion. But even after eliminating non-nuclear weapons production missions and a formal decision to continue operations at two old, unsafe buildings slated for replacement, the Uranium Processing Facility is now estimated to cost $8.5 billion. However, even that is not the final price, as NNSA is still to “rebaseline” UPF costs at some unspecified date.

Biden Releases Record NNSA Nuclear Weapons Budget

Santa Fe, NM – President Biden has released his proposed FY 2024 budget for the Department of Energy’s semi-autonomous nuclear weapons agency, the National Nuclear Security Administration (NNSA). The budget for NNSA’s “Total Weapons Activities” for nuclear weapons research and production programs is slated to increase by 10% to $18.8 billion.

Of that $18.8 billion requested for FY 2024, over $3 billion is devoted to “Life Extension Programs” or “Alterations” that extend the service lives of existing nuclear weapons by decades while giving them new military capabilities. It also includes two new-design nuclear weapons, the W87-1 ICBM warhead (increased 50% to $1 billion) and the sub-launched W93 warhead (increased 62% to $390 million). Meanwhile, funding for dismantlements that provide a good nonproliferation example and save taxpayers’ money by eliminating long-term security costs is decreased by 4% to $53.7 million. That is a small fraction of one percent of NNSA’s Total Weapons Activities.

Two bright spots, yet still small relative to the U.S.’ planned $2 trillion nuclear weapons “modernization” program, are the zeroing out of funding for the Sea-Launched Cruise Missile (SLCM) warhead and stronger language on the retirement of the 1.2 megaton B83 bomb. Trump proposed to bring back nuclear-armed sea-launched cruise missiles, which were retired by President George H. Bush after the end of the Cold War. Biden’s 2022 Nuclear Posture Review canceled the SLCM, but Congress insisted on funding it, which will only grow stronger with Republican control the House.

Santa Fe, NM – Today, the National Nuclear Security Administration[1] (NNSA) finally posted its FY 2022 Performance Evaluation Reports to its electronic “FOIA Reading Room.” These reports are “Frequently Requested Documents” as defined by the Freedom of Information Act (meaning three or more requests) and are therefore required to be posted under the law. The catalyst for this was a lawsuit filed by Nuclear Watch New Mexico in September 2022.

NNSA’s Performance Evaluation Reports for its eight nuclear weapons research and production sites[2] grade annual contractor performance and award performance fees accordingly. Approximately 57,000 people are employed by the NNSA nuclear weapons complex, 95% of them contractor personnel. The Department of Energy and NNSA (or its predecessor DOE Defense Programs) have been on the independent Government Accountability Office’s “High Risk List” for project mismanagement and waste of taxpayers’ dollars since 1992.

The Biden Administration is releasing its Fiscal Year 2024 federal budget on Thursday, March 9. It is expected to be a “skinny budget” with just topline financial numbers. If the pattern of the last few years for the Department of Energy’s (DOE’s) budget is continued, there can be three more releases over the next six weeks that grow progressively more detailed (there is initially little if any site-specific budget information). Historically around 60% of DOE’s funding has been earmarked for nuclear weapons production and cleanup of Cold War wastes and contamination.

The release of the presidential budget begins the annual legislative process for funding DOE programs and sites. The two bicameral congressional subcommittees that have jurisdiction over the DOE budget are the Armed Services Committee Strategic Forces Subcommittee which “authorizes” funding, and the Energy and Water Development Appropriations Subcommittee which actually provides funding. Congress has managed to pass the Defense Authorization Act for more than 50 consecutive years, but is increasingly unable to pass appropriations bills, leading to short-term Continuing Resolutions (CRs). Given bipartisan friction and the beginning of election campaigning, Continuing Resolutions are likely for this coming federal fiscal year 2024, which begins October 1, 2023.

The Alliance for Nuclear Accountability strongly opposed the massive 25% FY 2021 increase that the Trump Administration gave to the nuclear weapons programs of DOE’s semi-autonomous National Nuclear Security Administration (NNSA). The Biden Administration not only kept Trump’s increases in subsequent budgets but substantially added to them, particularly for expanded production of plutonium “pit” bomb cores for nuclear weapons. Meanwhile, dismantlements of nuclear warheads have slowed to a crawl and funding for cleanup of Cold War radioactive and hazardous wastes has remained flat.

DOE’s nuclear weapons and environmental management programs have been on the Government Accountability Office’s “High Risk List” for project mismanagement and waste of taxpayers’ dollars for more than 30 consecutive years. Defense Department and DOE costs for so-called “modernization” of U.S. nuclear forces begun under Obama is expected to be around $2 trillion over the next 30 years.

At a February 9, 2023 public community forum hosted by the Department of Energy’s Environmental Management Los Alamos Office, there were strong indications that the New Mexico Environment Department (NMED) is convinced that DOE’s plans to remediate the chromium groundwater contamination plume under Los Alamos National Laboratory (LANL) is not working. Kimberly Lebak, program manager for N3B, the LANL cleanup contractor, described how it is finalizing the 2023 milestones under the Consent Order that governs cleanup, despite the fact that the NMED Groundwater Bureau has requested that DOE stop injecting treated water by April 1, 2023. DOE and NMED are not seeing eye-to-eye concerning the “Interim Measure” that N3B is using to contain the chromium plume.

The two agencies disagree on the Interim Measure, originally designed to prevent chromium from migrating across the San Ildefonso Pueblo border while DOE tries to figure out a final remedy.

District Court Denies Department of Energy’s Motion to Dismiss Plutonium Pits Suit

AIKEN, S.C. — In a win for public participation and environmental protection, the United States District Court of South Carolina denied the Department of Energy’s motion to dismiss a 2021 legal action filed by multiple citizen groups. The suit was prompted by the agencies’ failure to take the “hard look” required by the National Environmental Policy Act at their plans to more than quadruple the production of plutonium pits for new nuclear weapons and split their production between the Los Alamos National Laboratory and the Savannah River Site.

In her ruling, Judge Mary Geiger Lewis thoroughly rejected the defendants’ arguments that the plaintiffs lacked standing, saying it was “not a close call”.

“We were able to defeat yet another attempt to use standing as a weapon to keep members of the public out of the government’s decision-making process,” said Leslie Lenhardt, Senior Managing Attorney at the South Carolina Environmental Law Project (SCELP).

To date, the Department of Energy (DOE) has refused to fully examine the environmental and safety impacts of their cross-country plan, which would create massive quantities of dangerous and radioactive material, put hundreds of billions of taxpayer dollars on the line, risk a new nuclear arms race, and violate the nation’s foundational environmental law.

During that time, she was privy to NMED litigation strategy against DOE and chaired the New Mexico Water Quality Control Commission that denied a citizens’ motion against one of LANL’s most crucial facilities for expanding plutonium pit production, the Radioactive Liquid Waste Treatment Facility. As a result, the New Mexico Ethics commission fined Stringer a paltry $250. Assuming that Stringer is earning at least $100,000 base salary in her new position, that fine would have cost her approximately five hours of her time.

Nuclear Watch New Mexico takes particular interest in the Livermore Lab as the sister lab of the Los Alamos National Laboratory (LANL). We have long been involved in the issue of plutonium pit production at LANL. We see the two labs as inextricably linked given that LANL will be producing plutonium pits for the new W87-1 warhead, for which LLNL is the lead design agency.

Independent Government Accountability Office Releases Scathing Report on Expanding Plutonium Pit Production; Pressure Mounts on Los Alamos Lab to Increase Production

Santa Fe, NM – Today, the independent Government Accountability Office (GAO) released a scathing report entitled NNSA Does Not Have a Comprehensive Schedule or Cost Estimate for Pit Production Capability. The National Nuclear Security Administration (NNSA) and its parent Department of Energy have been on the GAO’s High Risk List for project mismanagement since 1991.

Plutonium pits are the essential radioactive cores of nuclear weapons. There has been only limited production at the Los Alamos National Laboratory (LANL) since 1989 when a FBI raid investigating environmental crimes abruptly shut down production at the Rocky Flats Plant near Denver. NNSA now plans to spend $2.9 billion in FY 2023 alone to establish production of at least 30 pits per year at LANL and 50 pits per year at the Savannah River Site (SRS) in South Carolina.

The two main findings of GAO’s report are:

  • NNSA’s Plutonium Pit Production Scope of Work Includes Dozens of Programs, Projects, and Other Activities Managed by Multiple NNSA Offices at Multiple Sites (p 19)

New Mexico’s Revolving Nuclear Door: Top Environment Officials Sell Out to Nuclear Weapons Labs

Santa Fe, NM – As part of a long, ingrained history, senior officials at the New Mexico Environment Department (NMED) have repeatedly resigned to go to work for the nuclear weapons labs, the Department of Energy, or DOE contractors. In a number of cases that is where they came from to begin with.

The hierarchy of leadership at NMED starts with the Secretary, Deputy Secretaries and then Division Directors. The position of Resource Protection Division Director is particularly critical because it oversees the two NMED bureaus most directly involved with DOE facilities in New Mexico, the Hazardous Waste Bureau and the DOE Oversight Bureau. However, all four former or current Resource Protection Division Directors have gone or are going to work for the nuclear weapons labs, the DOE or its contractors. They are:

Biden’s Nuclear Posture Review Fuels the New Nuclear Arms Race

Santa Fe, NM– Today, the Biden Administration has released its long awaited unclassified Nuclear Posture Review. It headlines a “Comprehensive, balanced approach to defending vital national security interests and reducing nuclear dangers.” It also declares that “deterrence alone will not reduce nuclear dangers.”

“Deterrence” against others has always been the publicly sold rationale for the United States’ nuclear weapons stockpile. First, there is the inconvenient fact that the U.S. was the first and only to use nuclear weapons in war. But secondly, the United States and the USSR (now Russia) never possessed their huge stockpiles for the sole purpose of deterrence anyway. Instead, their nuclear weapons policies have always been a hybrid of deterrence and nuclear war fighting, which threatens global annihilation to this very day.

As a pertinent example, after the Obama Administration released its 2010 Nuclear Posture Review, the Defense Department declared that, “…[t]he new guidance requires the United States to maintain significant counterforce capabilities against potential adversaries. The new guidance does not rely on a ‘counter-value’ or ‘minimum deterrence’ strategy.”[1] In simple language, that means nuclear war-fighting that could end civilization should deterrence fail, or even possible first strike. That is why we have thousands of nuclear weapons instead of just the few hundred needed for only deterrence. That is why we have the massive, $1.7 trillion “modernization” program that will keep nuclear weapons forever, for which Biden’s Nuclear Posture Review gives added policy foundation.

Watchdogs File Suit for NNSA’s Performance Evaluation Reports

Santa Fe, NM – Today, Nuclear Watch New Mexico has once again filed a lawsuit to pry loose the National Nuclear Security Administration’s (NNSA’s) full and complete Performance Evaluation Reports that evaluate contractor performance at its eight nuclear weapons sites. Approximately 57,000 people are employed by NNSA’s nuclear weapons production complex, 95% of them contractor personnel. NNSA and its parent Department of Energy have been on the independent Government Accountability Office’s “High Risk List” for project mismanagement and waste of taxpayers’ dollars since 1992.

NNSA’s Performance Evaluation Reports grade contractor performance, award performance fees and contain no classified information. Nevertheless, NNSA seeks to hide how taxpayers’ money is spent from the public, issuing only terse three page summaries instead of the full and complete Reports. Nuclear Watch sued in 2012 to obtain the full and complete Performance Evaluation Reports, after which NNSA started releasing them within three working days. But NNSA has again been releasing only summaries since 2019, despite a Freedom of Information Act request by Nuclear Watch that the agency never responded to.

To illustrate the importance of these Performance Evaluation Reports, in its FY 2021 Los Alamos Lab summary NNSA noted that the contractor “[s]ucessfully made advances in pit production processes…” Plutonium “pits” are the fissile cores of nuclear weapons whose expanded production the Pentagon has identified as the number one issue in the United States’ $2 trillion nuclear weapons “modernization” program. NNSA has directed the Los Alamos National Laboratory (LANL) to begin producing at least 30 pits per year by 2026 and the Savannah River Site (SRS) in South Carolina to begin producing at least 50 pits per year by 2030.

NNSA Finally Starts Overdue Los Alamos Lab Environmental Study for Nuclear Weapons Programs That Are Already Underway

Santa Fe, NM – Today, the National Nuclear Security Administration (NNSA), the semi-autonomous nuclear weapons agency with the Department of Energy, released a Notice of Intent to Prepare a Site-Wide Environmental Impact Statement for Continued Operation of the Los Alamos National Laboratory.

In its formal notice, NNSA avoids mentioning the elephant in the room, the already predetermined expanded production of plutonium “pits,” the radioactive cores of nuclear weapons. This is in direct contradiction to the National Environmental Policy Act’s requirement that federal agencies take a “hard look” at proposed actions before implementation.

Moreover, future pit production is not to maintain the safety and reliability of the existing stockpile, but instead is for speculative, untested new-design nuclear weapons for the accelerating nuclear arms race. The Los Alamos National Laboratory (LANL) is already spending billions of taxpayers’ dollars to upgrade plutonium facilities and hire more workers for more weapons of mass destruction. This site-wide EIS is a “check off the box” exercise for all the major changes since the last site-wide EIS in 2008. Since then the Lab has fundamentally changed into a nuclear weapons production site as its main mission.

The Department of Energy boosted Lab funding to $4.6 billion in FY 2023 (21% higher than FY 2022), which begins this coming October 1. Of that, $3.6 billion is slated for NNSA’s core nuclear weapons research and production programs, with expanded plutonium pit production taking the biggest slice of the pie at $1.63 billion. The percentage of nuclear weapons funding at LANL has steadily grown as the Lab increasingly banks its future on being a nuclear weapons production site. Today it is 73% of total institutional funding. country.

Billions of Taxpayer Dollars to be Spent on Plutonium Pit Production – NNSA Chooses Speed Over Safety, Condones Potential Lethal Radioactive Doses to Public

Santa Fe, NM – The National Nuclear Security Administration (NNSA), the semi-autonomous nuclear weapons agency with the Department of Energy, is no longer pursuing a safety class active confinement system at PF-4, the Los Alamos National Laboratory’s plutonium pit manufacturing facility. This is a long-running battle between the independent Defense Nuclear Facilities Safety Board (DNFSB) and NNSA.

The Safety Board has strongly recommended active confinement systems since 2004, reporting that they “will continue to function during an accident, thereby ensuring that radioactive material is captured by filters before it can be released into the environment.” [i] However, a few years ago NNSA tried to kill the messenger by seriously restricting DNFSB access to NNSA nuclear facilities across the country.

New Mexico: Number One in Nuclear Weapons and Radioactive Wastes Near Last in Citizen and Child Well-Being

Santa Fe, NM – According to budget documents just released by the Department of Energy, DOE facilities in New Mexico will receive $9.4 billion in FY 2023, substantially larger than the state’s entire operating budget of $8.5 billion. Seventy-one percent ($6.7 billion) will be for core nuclear weapons research and production programs under the DOE’s semi-autonomous nuclear weapons agency, the National Nuclear Security Administration (NNSA). That is 40.5% of the NNSA’s total nation-wide nuclear weapons budget of $16.5 billion. It is also double that of the next closest state, since the Land of Enchantment has two of the nation’s three nuclear weapons laboratories (the Los Alamos and Sandia National Laboratories). Both of these Labs are within the Roman Catholic Archdiocese of Santa Fe, whose Archbishop John Wester has echoed Pope Francis’ call for the abolition of nuclear weapons.

In contrast, the goal of NNSA programs in New Mexico is to indefinitely extend the service lives of existing nuclear weapons while giving them new military capabilities. This will be followed by completely new nuclear weapons that cannot be tested given the global testing moratorium. Alternatively, it could prompt the U.S. back into nuclear weapons testing, which would have serious international proliferation implications. NNSA’s claimed rationale is “deterrence” which requires only a few hundred nuclear weapons. In reality the U.S. and Russia each have thousands of ready-to-launch weapons for nuclear war-fighting that would result in global catastrophe, no longer so hypothetical since Russia’s invasion of Ukraine.

Multi-state coalition says DOE’s plans to massively expand plutonium pit production violate a major environmental law and constitutes an environmental injustice.

Jay Coghlan of Nuclear Watch New Mexico commented, “Instead of maintaining the safety and reliability of the existing nuclear weapons stockpile, NNSA may actually undermine it because all future pit production is for speculative new-design nuclear weapons. In Tuesday’s letter to department officials, the groups say this lack of review violates the National Environmental Policy Act (NEPA) and would saddle already-burdened communities nearby the two DOE sites with significant quantities of toxic and radioactive waste, contravening President Biden’s executive order of making environmental justice a part of the mission of every agency.

Local Governments Should Leave the Regional Coalition of LANL Communities

Summary: Local governments get little in return for being members of the Regional Coalition of LANL Communities (RCLC). That is because the Coalition is ineffective, dysfunctional, wastes taxpayers’ money and stands in the way of genuine, comprehensive cleanup at the Los Alamos National Laboratory. The RCLC was created to serve the interests of the Department of Energy and Los Alamos County, both of whom strongly support expanded plutonium pit production for new nuclear weapons and supply 80% of the Coalition’s funding. The Regional Coalition brings no discernible economic benefit to local governments other than already rich Los Alamos County because the Lab’s presence is an economic net loss to them. Local governments should not put their time and money into the Coalition. Instead, their constituents would be better served if local governments left the coalition and advocated for comprehensive cleanup that would permanently protect the environment while providing hundreds of high paying jobs.

Background

In 2011 the Department of Energy pulled promised funding from the Community Involvement Fund administered by the New Mexico Community Foundation that supported independent, often critical citizen and tribal analyses of DOE cleanup programs. At the same time DOE began funding the Regional Coalition of LANL Communities modeled on earlier alliances with local governments around the Rocky Flats Plant near Denver, CO and the Mound Plant, near Mound, OH.

New Mexico Environment Department Takes Legal Action To Terminate Defective LANL Cleanup “Consent Order”

FOR IMMEDIATE RELEASE, February 25, 2021

The New Mexico Environment Department has announced that it is filing a lawsuit against the Department of Energy to terminate a “Consent Order” governing cleanup at the Los Alamos National Laboratory (LANL). Nuclear Watch New Mexico, which has fought against that Consent Order ever since it went into effect nearly five years ago, strongly supports and applauds NMED’s decision.

Much to its credit, in 2005 the State of New Mexico successfully compelled DOE to enter into a strong, enforceable Consent Order after years of tough negotiations and lawsuits brought against it by DOE and the University of California (then LANL’s manager). However, at the Lab’s request the anti-regulation Susanna Martinez Administration eviscerated that Consent Order with more than 150 milestone extensions.

Los Alamos Nuclear Weapons Lab Opens Office in the City of the Santa Fe (“Holy Faith”) of Peace and Environmental Protection

Santa Fe, NM – A Lab press release has announced that “[c]onnections between Los Alamos National Laboratory and the City of Santa Fe will be strengthened with the Laboratory’s opening of a new downtown office” after signing a 10-year lease on a 28,000-square-foot building. The Lab’s press release ignores LANL’s $2.9 billion nuclear weapons production budget (up 33% in one year), its proposed 46% cut to cleanup to $120 million, serious groundwater contamination and recent reports how it has neglected wildfire protection. Two catastrophic wildfires in the last 21 years on or near the Lab blanketed a large portion of northern New Mexico with possibly contaminated smoke.

The City of Santa Fe’s official name is the “La Villa Real de la Santa Fe de San Francisco de Asís” (“The Royal Town of the Holy Faith of Saint Francis of Assisi”), in honor of the beloved saint who preached peace and environmental protection and from whom the present Pope draws his name. Pope Francis has repeatedly called for the abolition of nuclear weapons and while in Japan paid homage to the victims of the Hiroshima and Nagasaki bombings. Those atomic bombs were designed and produced at the Los Alamos Lab.

LANL Falls Behind on Wildfire Protection While Expanding Nuclear Weapons Production Watchdog Calls for New Site-Wide Environmental Impact Statement

FEBRUARY 9, 2021

Santa Fe, NM – The Department of Energy’s Inspector General is reporting that the Los Alamos National Laboratory (LANL) is falling seriously behind in wildfire protection. This is despite the fact that the 2000 Cerro Grande Fire forced the mandatory evacuation of both LANL and the Los Alamos townsite, burned 3,500 acres of Lab property and came within a half-mile of Area G, its largest waste dump. At the time Area G stored above ground some 40,000 barrels of plutonium-contaminated radioactive wastes. It could have been catastrophic had they burst and sent respirable airborne plutonium across northern New Mexico (inhaled plutonium is a very serious carcinogen).

In 2011 the Los Conchas Fire raced 13 miles in 24 hours to the Lab’s western boundary, where it was stopped along State Highway 4. Both it and the Cerro Grande Fire sent huge plumes of harmful smoke across northern New Mexico, possibly carrying Lab contaminants as well (operation of radioactive air emissions monitoring equipment was suspended during the Cerro Grande Fire).

The Los Alamos National Laboratory (LANL) proposes to vent up to 114,000 curies of radioactive tritium gas to the open atmosphere while claiming that it poses no public health and safety risks. Public outcry and congressional pressure prompted the National Nuclear Security Administration (NNSA) to host a public information virtual meeting on this issue on October 20. Due to the overwhelming turnout of some 150 interested citizens and ear-splitting technical difficulties NNSA is holding another public virtual meeting at 5:00 pm Thursday November 5.

The U.S. Department of Energy (DOE) today issued a formal decision that it will pursue a massive Plutonium Bomb Plant (PBP) at the DOE’s Savannah River Site (SRS) in South Carolina, in order to produce plutonium “pits,” or cores, for nuclear warheads. The provocative decision, which adds fuel to concerns about a new nuclear arms race with Russia and China, drew immediate opposition from public interest groups near DOE sites in South Carolina, New Mexico and California.

The issuance by DOE’s National Nuclear Security Administration (NNSA) of the “Record of Decision” (ROD) on the Environmental Impact Statement (EIS) on pit production at SRS, issued in late September, officially affirms the “preferred alternative” that DOE intends to produce a minimum of 50 plutonium “pits” per year by 2030 at SRS. Also on November 5, NNSA issued an “Amended Record of Decision” (AROD) to its 2008 nation-wide Complex Transformation Programmatic Environmental Impact Statement that incorporated its SRS pit-production decision.

I appreciate this opportunity to submit comments on the scope of the National Nuclear Security Administration’s (NNSA) Site-Wide Environmental Impact Statement (SWEIS) for the continued operation of the Lawrence Livermore National Laboratory (LLNL) Main Site in Livermore, CA and Site 300 high explosives testing range near Tracy, CA.

Nuclear Watch New Mexico is a nonprofit watchdog organization based in Santa Fe, New Mexico. We seek to promote safety and environmental protection at nuclear facilities; mission diversification away from nuclear weapons programs; greater accountability and cleanup in the nation-wide nuclear weapons complex; and consistent U.S. leadership toward a world free of nuclear weapons.

Pursuant to the National Environmental Policy Act the purpose of scoping is: “early identification of concerns, potential impacts, relevant effects of past actions and possible alternative actions.” Therefore, I ask that the analyses I am requesting be fully undertaken – and my questions fully answered – in the draft SWEIS.

First, I am skeptical of the timing of the initiation of this new SWEIS for LLNL during the COVID-19 pandemic and just before the November 3 election. As a prerequisite, the
National Nuclear Security Administration (NNSA) should have already begun a nationwide programmatic environmental impact statement (PEIS) on expanded plutonium pit
production which would then inform the LLNL SWEIS of the Livermore Lab’s role in that national effort, which is not insignificant. Following that pit production PEIS, both a
LLNL and Los Alamos National Laboratory SWEIS should proceed in parallel. It is particularly striking that NNSA is claiming NEPA compliance while relying on an
outdated Complex Transformation Supplemental PEIS and LANL SWEIS, both completed in 2008, and refusing to prepare new or supplemental ones.

Ironically the day after the film Oppenheimer was awarded multiple Oscars, the Department of Energy’s semi-autonomous National Nuclear Security Administration (NNSA) asked Congress for its biggest nuclear weapons budget ever. NNSA’s FY 2025 request for “Total Weapons Activities” is $19.8 billion, $700 million above what Congress recently enacted for FY 2024. It is also a full billion dollars above what President Biden asked for last year, which Congress then added to and will likely do so again.

The Biden Administration states that the $19.8 billion will be used to:

“[P]rioritize implementation of the 2022 National Defense Strategy and Nuclear Posture Review by modernizing the Nation’s nuclear deterrent to keep the American people safe. The Budget supports a safe, secure, reliable, and effective nuclear stockpile and a resilient, responsive nuclear security enterprise necessary to protect the U.S. homeland and allies from growing international threats.” whitehouse.gov/wp-content/uploads/2024/03/budget_fy2025.pdf, page 75.

The 2022 National Defense Strategy and Nuclear Posture Review for the first time posited two nuclear “near peers”, i.e. Russia and China, that need to be simultaneously “deterred.” This hinted at a potentially large nuclear buildup which this budget may now be implementing. That claimed need to deter two nuclear near peers was explicitly taken a step beyond just deterrence in an October 2023 report from the Strategic Posture Commission. It declared:

“Decisions need to be made now in order for the nation to be prepared to address the threats from these two nuclear-armed adversaries arising during the 2027-2035 timeframe. A Note on the Value of Site-Wide EISs in Midst of Texas Wildfires Updates

The 2000 Cerro Grande Fire burned 3,500 acres of Los Alamos National Lab property and more than 250 homes in the Los Alamos townsite (I could see the bursts of propane tanks from my house 25 miles away).

It would have been worse except for a 1999 LANL Site-Wide Environmental Impact Statement (SWEIS) which postulated a hypothetical wildfire that eerily matched the real fire. That hypothetical fire was in the final SWEIS only because citizens (i.e. me) pointed out that DOE did not consider wildfire risk in the draft SWEIS.

Release of federal FY 2025 budget expected March 11 (it will initially be just topline numbers).

Meanwhile on the FY 2024 budget: House and Senate Armed Services Committee authorized funding exceeding Biden’s request, including money for the Sea-Launched Cruise Missile and nuclear warhead (reminder: that the President doesn’t want), plus adding $$ for plutonium pit production at the Savannah River Site. But appropriations bills are still not happening because of ever increasing congressional dysfunction. This is now best exemplified by Republicans rejecting an immigration bill they initially drafted but that Trump denounced because he wanted immigration to remain a hot issue during the presidential election campaign.

The current second “laddered” Continuing Resolution that is keeping the government running expires March 1 and 8.

NNSA Suppresses How Taxpayers Money Is Spent

The National Nuclear Security Administration (NNSA) has just released cursory two or three page summaries of contractors’ performance paid for by the American taxpayer. For the just ended fiscal year 2023, NNSA gave nothing less than grades of “Excellent” or “Very Good” in six broad mission goals for its major contractors. This is despite the constant cost overruns and schedule delays that are the rule, not the exception, in the nation-wide nuclear weapons complex. NNSA and its parent Department of Energy have been on the Government Accountability Office’s “High Risk List” for project mismanagement ever since GAO started that List in 1991.

A current example is the Uranium Processing Facility (UPF) at the Y-12 Plant near Oak Ridge, Tennessee, originally estimated in 2011 to cost $1.4 to $3.5 billion. After costs started going through the roof, NNSA and Senator Lamar Alexander (R.-TN), then-chair of Senate Energy and Water Appropriations, swore that UPF would never go over $6.5 billion. But even after eliminating non-nuclear weapons production missions and a formal decision to continue operations at two old, unsafe buildings slated for replacement, the Uranium Processing Facility is now estimated to cost $8.5 billion. However, even that is not the final price, as NNSA is still to “rebaseline” UPF costs at some unspecified date.

As New Mexicans Struggle, Sen. Heinrich is Proud of Nuclear Weapons Money

Sen. Heinrich is so proud of all of the nuclear weapons money in New Mexico. He is one of the chief congressional architects of expanded production of plutonium “pit” bomb cores and sits on the Senate Energy and Water Appropriations Subcommittee from where he can direct $$billions to the Sandia and Los Alamos Labs.

But during the Department of Energy’s long presence in the Land of Enchantment, according to Census Bureau data New Mexico has slid in per capita income from 32nd in 1959 to 47th in 2022. New Mexico has the most children living in poverty (30%) and is rated dead last in well-being of children and quality of public education. Finally, in a report that the Los Alamos Lab tried to suppress, six county governments surrounding Los Alamos County suffer a net economic loss from LANL.

In fiscal year 2024 DOE will spend $10 billion in New Mexico, 75% for core nuclear weapons research and production programs and 5% for dumping related radioactive wastes in our state. DOE’s budget is 6% greater than the entire operating budget of the State of New Mexico ($9.4 billion).

Senator Heinrich, please explain what good all that nuclear weapons money does for average New Mexicans, and not just for the privileged nuclear weapons enclaves.

House Speaker Johnson agreed to a previous funding agreement with the Biden Administration but the so-called Freedom Caucus is now in revolt.

Update: On January 18, Congress passes third stopgap funding bill instead of full FY24 budget, keeping the government funded until March.

North Korea Issues Ominous Warning About Nuclear Strike This Year
North Korea has issued an ominous warning about “the highest risk of clashes this year” between the totalitarian state and its neighbor to the south, which could end in “a nuclear strike,” according to South Korean media. Yonhap News Agency, a major media outlet in Seoul, reported on Thursday that North Korea media condemned recent Army artillery exercises and naval firing drills and exercises. The Korean Central News Agency (KCNA), the state news agency of North Korea, said the exercises are “self destructive” and called South Koreans “warmongers,” according to Yonhap.

The New Mexican’s sycophantic reporting on the Los Alamos Lab

The New Mexican has just published “New ideas, technologies from LANL could boost region’s economy” on how the Lab wants to “rebrand” itself.  I posted the following response on the newspaper’s web site:

 

This is more of The New Mexican’s sycophantic reporting on the Los Alamos Lab. It’s a long tradition, going back to the early 1990’s when the newspaper’s previous owner (and ex-member of the Department of Energy’s predecessor, the Atomic Energy Commission) fired two reporters who wrote the groundbreaking series “Fouling the Nest” critical of the Lab. Further, he paid off his managing editor to stay quiet about it. Nevertheless, the Columbia University School of Journalism wrote a scathing review on the whole affair decrying “the nuclear meltdown at The New Mexican.”

Or how about in the same period of time when The New Mexican wrote a glowing editorial praising the executive summary of a 1992 LANL Strategic Plan that crowed about the potential for regional economic development through tech transfer from the Lab (sound familiar?).

There were only two problems: 1) those “Cooperative Research and Development Agreements” between LANL and the private sector never did produce significant local economic development; and 2) the Lab had bamboozled The New Mexican because the main body of its 1992 Strategic Plan explicitly said that nuclear weapons are and always will be the LANL’s “raison d’etre.” That remains true to this day, when just under 2/3’s of the Lab’s budget is for core nuclear weapons research, testing and production programs. Moreover, the for–profit corporation (including war-profiteer Bechtel and the University of California) running LANL plans on a never ending cycle of “Life Extension Programs” that will extend the service lives of nuclear weapons for decades while giving them new military capabilities.

This article’s implied claim that the labs’ national security missions are significantly moving away from nuclear weapons is baloney. In addition, show me the money that will make this pipedream of regional economic development through Lab tech transfer happen (especially when it has failed before). It won’t come from the federal government in this fiscal environment, and the quote that “you’d see private investments pouring in” is empty economic propaganda.

Business at LANL makes no sense because doing business at LANL simply costs too much, when each program dollar also costs an overhead dollar (which historically has been used in part to subsidize nuclear weapons programs). And the examples cited, partnerships with oversized corporations such as Chevron and Proctor and Gamble, please show me what that has done for Main Street Española.

Maybe one of these days the New Mexican could again do some groundbreaking critical investigative reporting on the Lab without firing its reporters. I look forward to that day.

As expected, this was a rah rah session for the B61 Life Extension Program. My opposing comments are mostly in response to the testimonies of witnesses. Their prepared statements are available at

Two background notes:

Cost: The estimated weight of individual B61 bombs is ~700 lbs. Gold is currentlly priced at $1,353 per troy ounce. Up to 500 B61s will be refurbished, costing ~$11.8 billion (including DoD tail fin kit). Therefore each bomb will cost more than twice its weight in gold.

The National Nuclear Security Administration (NNSA) proposes a “3+2” strategy for the future stockpile of three ballistic missile warheads and two air-delivered warheads (one gravity bomb and one air-launched cruise missile warhead). All four witnesses claimed the 3+2 strategy will lead to stockpile reductions. However, a comparison of NNSA’s FY 2014 Stockpile Stewardship and Management Plan (in which the 3+2 strategy is first introduced) to previous years’ plans shows no further reductions to the stockpile than what is already incrementally planned. Despite their testimony there is no demonstrable link between 3+2 and stockpile reductions. In fact stockpile size may be bumped up while keeping old warheads as a hedge while seeing how the new warheads work out.

 

Donald Cook, Deputy Administrator for Defense Programs, National Nuclear Security Administration

Cook touted the virtues of “interoperable” warheads, the first on deck being for the Air Force’s W78 ICBM warhead and the Navy’s sub-launched W88 warhead. However, a recent GAO report has noted that “the Navy has not fully engaged in the effort because (1) other, ongoing modernization programs are higher Navy priorities, and (2) it has concerns about changing the design of the warhead.” [1] This understates the Navy’s concerns, when the service actually seems very skeptical about so-called interoperable warheads. The Navy’s lack of keen endorsement can be enough to kill this concept, especially in combination with inevitably exorbitant costs.

“…let me be clear that the resulting decision supported the lowest cost option that meets threshold military requirements.” With that Cook is pushing back against the Senate Appropriations Committee, which cut $168 million from the Obama Administration’s FY 2014 request of $537 million for the B61 LEP, while stating:

 The Committee is concerned that NNSA’s proposed scope of work for extending the life of the B61 bomb is not the lowest cost, lowest risk option that meets military requirements and replaces aging components before they affect weapon performance. [2]

The question of military requirements is key, and whether that may be synonymous with new military capabilities. NNSA and the nuclear weapons labs chose Option 3b for the B61 LEP. As Cook testified, “…Option 3B architecture allows for consolidation of existing B61 variants (B61-3/4/7/10) with the integration of an Air Force provided tail kit assembly.” That tailfin kit will dramatically increase targeting accuracy, functionally melding tactical and strategic variants. The NNSA LEP itself will transform a dumb analogue bomb into a digital nuclear “smart” bomb for delivery by future super stealthy aircraft (the F-35 Joint Strike Fighter). In my view, this combination clearly creates new military capabilities.

Senate Appropriations favors Option 1E, a non-nuclear LEP. The difference in House and Senate funding levels represents a struggle over new military capabilities or not.

Cook stated that sequester cuts made the B61 LEP slip 6 months, so NNSA added $244 million to “management reserve” to offset potential increased costs and risks.

“The B61-12 LEP is making great progress. We are in the second year of full scale engineering development. The program has met its development milestones, it is on schedule and it is on budget.”  That is laughable. On budget? Really?

“…cascading effect on the integrated schedule of LEP work….” The likely failure of the B61 LEP will have cascading impact on subsequent LEPs.

“Sustained support for the completion of the B61-12 will enable the retirement of the B83…”  Not so, the B83 was already planned for retirement (B83-0s are already being dismantled as per the Pantex Ten-Year Site Plan). The proof is the absence of any proposed LEP for the B83-1 in NNSA’s FY 2014 Stockpile Stewardship and Management Plan.

Right at the end of Q&A Cook made the outrageous statement that to descope the LEP and do anything else would cost more than the LEP itself. He gave no supporting evidence or justification for that.

 

Madelyn Creedon, Assistant Secretary of Defense for Global Strategic Affairs, Department of Defense

She said 3+2 will save money. Where is the proof? The track record suggests otherwise. Simple maintenance (“curatorship”) is what would save money while not risking reliability through major changes.

 

General C. Robert Kehler, USAF Commander, US Strategic Command

“Through a series of synchronized life extension programs like the B61-12, we plan to improve confidence in the reliability, safety and intrinsic security of our nuclear weapons.” To the contrary, introducing major changes that can’t be tested to a stockpile that has been extensively tested could be exactly what undermines confidence in reliability.

 

Paul Hommert, Sandia Labs Director

Bear in mind that Hommert wears two hats: the first as Sandia Labs Director, the second as president of the executive board of the for-profit limited liability corporation that runs Sandia. Sandia Corporation, LLC stands to make a lot of money off of perpetual Life Extension Programs.

“…it is our technical judgment that we must complete the life extension program currently being executed.” Ditto to the above.

LANL Finds a Way to Very Efficiently Waste $400,000

The Department of Energy (DOE) recently released an Audit Report on “The Department’s Fleet Vehicle Sustainability Initiatives at Selected Locations”. One of the locations investigated was Los Alamos National Laboratory.  The report states that LANL leased 522 flex-fuel vehicles that were routinely fueled with regular gasoline instead of alternative fuels such as E-85. Sadly, DOE paid a premium of about $427,900 to acquire these flex-fuel vehicles rather than purchasing conventionally-fueled vehicles. (The report stated that $700,000 was spent for 854 flex-fuel vehicles, which was for 522 at LANL and 332 at Bonneville. I had use a simple ratio to arrive at the $427,900 average split for LANL because the DOE IG would not give the actual breakouts.)

By acquiring flex-fuel vehicles but continuing to fuel these vehicles with petroleum at LANL and Bonneville, the Department is not maximizing the reduction of greenhouse gas emissions. DOE  paid at least $427,900 for flex-fuel vehicles at LANL; however, failed to obtain the environmental benefits or further Departmental goals of increasing alternative fuel use and reducing petroleum use.

As of September 2012, LANL’s overall fleet had decreased by 9 vehicles, while the number of flex-fuel vehicles had grown to 587. According to LANL officials, LANL used a tanker truck to bring fuel to LANL to fill approximately 65 security vehicles with ethanol fuel. The tanker truck operated approximately 3 hours per day, 5 days per week, and the weekly labor costs to operate the truck were $1,200. Additionally, LANL spent $3,760 on maintenance and repair of the truck in calendar year 2012. The total cost of maintaining and operating the truck, excluding fuel costs, was approximately $66,000 for calendar year 2012. But this tanker truck, or one like it was never used for the regular flex-fuel vehicles.

In addition, the Lab had trouble letting go of unneeded vehicles. LANL retained about 25 percent of their fleets (269) and other mobile equipment even though they did not meet minimum utilization standards. Despite retaining underutilized vehicles, LANL actually increased its inventory of other motorized equipment (small motorized equipment not suitable for use on public roadways).

To be considered fully utilized at LANL, a vehicle must travel an average of 205 miles per month or make 6 trips per working day. According to documents provided by LANL officials, a utilization rate of less than 93 percent, meaning that less than 93 percent of fleet vehicles meet these utilization standards, is considered “unsatisfactory.” During FYs 2009 through 2011, LANL’s utilization rate was between 75 and 77 percent. For example, in FY 2011, LANL had a utilization rate of 76 percent meaning that 269 of 1,115 vehicles, or approximately 24 percent, were retained even though those vehicles did not meet the local utilization objectives.

LANL submitted written justification for retaining only 35 of the 269 underutilized vehicles. However, some of the justifications were very vague and did not sufficiently explain why the user needed to retain the vehicles instead of downsizing their fleet. One justification for retaining two underutilized vehicles stated, “because of the amount of employees and locations of employees, they would like to keep both vehicles. The plan is to switch them every 6 months to make sure we put enough mileage on both vehicles.” When addressing underutilized vehicles, the DOE IG noted the emphasis was often on increasing utilization as opposed to downsizing the fleet and, therefore, reducing costs. In regard to eight other underutilized vehicles, the justification stated, “all managers have devised a plan to increase the utilization of their vehicles and do not plan to turn any in at this time.”

Managing a fleet of vehicles is not rocket science. Hopefully this wasted money will be reimbursed by the operating contractor.

 

Each B61 nuclear warhead will cost ten times W76 warhead to refurbish

The over budget costs of near everything that the National Nuclear Security Administration touches is growing increasingly controversial. Of particular interest now is the Life Extension Program for some 400 B61 nuclear bombs. That program was originally going to cost $4 billion, but is now estimated at  ~$10.4 billion. At this point each 700 lb. bomb will cost more than twice its weight in gold. And this doesn’t include original production costs and ongoing support costs since they were first produced in the late 1960’s (which under “Stockpile Systems” is currently ~$80 million annually). And of course it doesn’t include the cost of the bombers over the years that were designed to deliver them.

In lockstep with NNSA’s Life Extension Program, a synchronized Pentagon program will provide new tail fin guidance kits that will transform the B61 into the world’s first nuclear “smart” bomb, for delivery by future super stealthy (and exorbitantly expensive) F-35 Joint Strike Fighters. That clearly constitutes new military capabilities, despite policy declarations at the highest levels of government (for example at the 2010 NonProliferation Treaty Review Conference) that the U.S. would never endow existing nuclear weapons with new military capabilities. An unarmed prototype of the refurbished bomb, designated the B61-12, is to be “flight tested” and dropped with the new tail fin kit in this FY 2014.

Stephen Young of the Union of Concerned Scientists recently made available an August 2012 JASON Report on the B61 Life Extension Program while providing his own excellent analysis http://allthingsnuclear.org/jason-on-the-b61/ [The JASONs are pretigious scientists periodically consulted with by the government on nuclear weapons issues.] Among their findings the JASONs reported “In implementing important and desirable, but not essential, elements in the 3B program [the 2nd most expensive B61 LEP option picked by the NNSA], there should be a clear understanding of their cost and impact on the schedule. These elements should be prioritized in the event that unanticipated program delays or cost overruns are encountered that could threaten meeting the FPU [first production unit] deadline.” The JASONs also noted “the Pentagon’s already strongly expressed displeasure at the inability to complete the W76 as scheduled.”

The W76 is one of two warheads for the Navy’s sub-launched Trident missiles, and is the single most common nuclear warhead in the U.S. stockpile. This got me wondering how much the W76 Life Extension Programs will cost, which I tracked down as follows:

The number of W76’s to be refurbished is classified, but is believed to be around 1,600. [In 2007 Hans Kristensen of the Federation of American Scientists estimated ~2,000 https://web.archive.org/web/20130630203617/http://blogs.fas.org/security/2007/08/us_tripples_submarine_warhead/), but told me that number has since been scaled down.] Using 1,600, then each W76 warhead will cost ~$2.31 million to refurbish. This is in contrast to the B61, more than ten times that at $26 million per warhead ($10.4 billion/400), or more than twice its weigh in gold.

The Senate Appropriations Committee has cut the NNSA’s FY 2014 budget request of $537 million for the B61 LEP (that request is a 45% increase above FY 2013) by $168 million. Its report said:

The Committee is concerned that NNSA’s proposed scope of work for extending the life of the B61 bomb is not the lowest cost, lowest risk option that meets military requirements and replaces aging components before they affect weapon performance.

According to the budget figures that I have compiled the W76 LEP is a 17-year program start to finish. In its FY 2014 Stockpile Stewardship and Management Plan NNSA claims that the much more complex (and hence much more expensive) B61 LEP will be completed in 10 years by 2024. Granted we’re talking about 4 times fewer nuclear weapons being refurbished, but the work is much more aggressive and involves 100’s of parts, all of which cannot be full-scale tested as a weapon (thank God!). And NNSA’s track record of staying on budget and on schedule is becoming a matter of scorn even amongst congressional staff.

The take away lesson is that NNSA and the labs should simplify. For the sake of stockpile maintenance limited life components such as neutron generators and tritium reservoirs should be replaced as needed, which is a near routine practice, and perhaps the B61’s radar needs replacement as well (which NNSA is fond of pointing out uses old style vacuum tubes). All of that would bring the costs down somewhere along the lines of the W76 LEP. It would also be better aligned with declared nonproliferation policy by not introducing new military capabilities, and better align with national security concerns by not possibly eroding confidence in stockpile reliability through major changes that can’t be full-scale tested. In addition, Congress should require NNSA to disclose in its budget requests annual costs per warhead type, as once was the practice, so that the public can be fully appreciate just how much each warhead costs for arguably archaic missions.

Finally, New Mexico’s Tom Udall sits on the Senate’s Appropriations Committee. He opposed the cut to the B61 LEP, among other things saying that he wanted to save 200 in-state jobs. That is no way to formulate nuclear weapons policy, especially given that the B61 Life Extension Program far exceeds mere maintenance. Tom Udall should support his own committee’s cut.

 

The B61 Life Extension Program is in increasing trouble

A well-placed source says the B61 Life Extension Program is in increasing trouble because:

•    In the just ended Fiscal year 2013 the sequester caused a $30 million cut to the program, resulting in a 6 month slip to the schedule and therefore added $230 million to the total cost of the program. [My comment: only in government can you cut 10’s of millions and end up adding 100’s of millions.]

•    If the current government shut down lasts more than 2 weeks, B61 activities will be curtailed, causing additional delays and therefore increasing costs.

•    Regardless of the present difference in House and Senate appropriations, the B61 LEP faces a $60 million cut in FY 2014 from sequestration and management efficiencies that cut 5% from the needed budget request.

•    Under the Continuing Resolution, since nuclear weapons activities did not get an anomaly, the B61 program cannot spend beyond FY 13 levels because of the Senate Energy and Water Appropriations bill.

•    At this point an omnibus appropriations bill is unlikely. But if House and Senate Appropriations were to go to conference (which is also unlikely) then there will be a battle over the different levels of funding for the B61 LEP.

•    There is already infighting within the Air Force about the future of the B61 and whether the cruise missile is more important to them. [My comment: this point is completely new to me and strikes as very exploitable, roughly analogous to the Navy’s fiscal predicament of new strategic subs vs. the rest of its fleet.]

•    As a subset to the point above, there is some talk about making the B61-12 the warhead for the new cruise missile, but that is very preliminary and wishful thinking. The B61 is not well suited for the environmental conditions and loads of a cruise missile and there needs to be sufficient diversity in the stockpile — you can’t make everything a B61.

The bottom line is that given opposition from both Senate Energy and Water and Defense Appropriations, which zeroed out the tail kit for the B61, the National Nuclear Security Administration and the Department of Defense may be finally realizing that they need to find alternatives to the full B61 Life Extension Program.

 

Audit Cites Lack of Contractor Integration For Delay in Reestablishing Criticality Capability

The Oct 2013 Department of Energy Inspector General (DOE IG) audit report “The Resumption of Criticality Experiments Facility Operations at the Nevada National Security Site” informs us that a move from Technical Area 18 (TA-18) at Los Alamos to the Nevada National Security Site, like many other DOE projects, is taking longer than planned. The report didn’t mention it but it, but the move is, no doubt, costing us more, too.

The move centers on relocating four criticality assemblies. Criticality experiments use “assemblies” of enriched uranium and/or plutonium to create self-sustaining nuclear chain reactions. These assemblies differ from nuclear reactors in that the nuclear reaction is not sustained (assuming there are no accidents). Another significant difference is that the critical assemblies have no containment or shielding.

A DOE fact sheet tells us that:

[National Criticality Experiments Research Center] NCERC contains the largest collection of nuclear critical mass assembly machines in the western hemisphere. These assemblies can be broadly categorized as benchmark critical assemblies, general-purpose assemblies, and fast- burst assemblies that were designed to accommodate a broad range of experiments. Godiva is a bare metal uranium fast burst assembly designed to provide an intense burst of neutrons during an extremely short pulse. Flattop is a unique fast-spectrum assembly used for cross section testing and training. Planet and Comet are general purpose vertical assembly machines that are designed to accommodate experiments in which neutron multiplication is measured as a function of separation distance between experimental components. Fuel materials include uranium, plutonium, and neptunium.

Clearly, safety and careful planning would be of the utmost importance with these operations, which include conducting nuclear criticality experiments along with hands-on, criticality safety, and emergency response training.

The fact sheet gives the reason for the move as, “As a result of the extensive inventory of SNM and the resulting requirements for physical security and operational safety, it was decided to relocate…”

The DOE IG report also explains that criticality experiments at Los Alamos were halted and moved to Nevada “Citing safety and security concerns in 2004…”

But both of these accounts leave out some interesting history. A Project On Government Oversight (POGO) article gives an account of a security training exercise at TA-18 at Los Alamos –

In 1997, a special unit of the U.S. Army Special Forces was the adversary during a force-on-force exercise. The normal theft scenario is to “steal” enough SNM for a crude nuclear weapon that would fit in rucksacks. But, according to the Wall Street Journal, this exercise required that they “steal” more HEU than a person can carry. Not to be outmaneuvered, the Army Special Forces commandos went to Home Depot and bought a garden cart. They attacked TA-18, loaded the garden cart with nuclear materials, and left the facility. “[T]he invaders reached the simulated objective of the game: enough nuclear material to make an atom bomb.”

And they did so with relative ease. As the Wall Street Journal reported,

“The Garden Cart attackers. . .used snipers hidden in the hills to “kill” the first guards [protective forces] who arrived. Because they happened to be the commanders of the guard force, the rest of the force was thrown into disarray. Many of them also were “killed” as they arrived in small groups down a narrow road leading to TA-18. ‘[The Special Forces] took them out piecemeal as they came in,’ says one participant in the game, whose account wasn’t challenged by DOE or lab officials.”

As the Wall Street Journal further noted, “The 1997 mock invasion succeeded despite months of guard [protective forces] training and dozens of computerized battle simulations showing that newly beefed-up defenders of the facility would win.”

In April 2000, then DOE Secretary Bill Richardson ordered that TA-18 be shut down and all the nuclear materials be completely removed by 2004. So instead of completing the move the 2004, DOE and Los Alamos Lab had only started the move by 2004. Nuclear Watch NM voiced our concerns many times, including when we learned that a Federal Safety Board concluded fatal doses were possible if there was an accident.

As far as operational safety goes, neither the fact sheet nor the DOE IG Report mentioned that TA-18 was intentionally located at the bottom of Parajito Canyon so that the 200-foot canyon walls could provide some natural radiation shielding. This meant that TA-18, with its estimated three tons of highly enriched uranium and plutonium, sat in a flood plain.

The results of the DOE IG audit states that many of the former capabilities of the were restored in Nevada. However, several problems resulted in delays in restoring the full array of experimental capabilities. NNSA was unable to authorize operations until May 2011, approximately 1 year after the planned date. The program experienced further delays in the start-up activities of each criticality machine, with completion of all planned startup activities for one machine delayed about 2 years.
DOE has not been able to restore full capability to perform plutonium-based criticality experiments.

The Report results state that delays occurred because contractors had not developed adequate procedures for correcting concerns identified during the process to authorize the start-ups. Also, procured safety equipment did not meet standards. Additionally, the Report claimed that DOE had not ensured effective management of the multiple contractors involved and had struggled to successfully integrate and resolve issues between the multiple contractors. Which is odd, because there were only four contractors mentioned in the report – Los Alamos, Lawrence Livermore National Laboratory, National Security Technology, LLC, Wackenhut Services International. Exactly what Wackenhut (which provides security, fire rescue and aviation services) did for the move was not stated.

We do appreciate the focus on safety, but if these operations are so important, DOE must emphasize completing the job to avoid wasting any more taxpayers’ money. Once again the Department of Energy proves that its contractors cannot juggle safety, schedule, and cost without dropping as least two. And apparently DOE has trouble efficiently juggling contractors, which is too bad because contractors attempt to perform over 90% of DOE’s work.

A recent press release from Los Alamos National Laboratory stated that the LANL “Board of Governors last week approved a $3.1 million extension to the company’s plan supporting education, economic development and charitable giving in Northern New Mexico.”

This, like most LANL statements, could use a little decoding.

1. The Lab’s contract with DOE requires community support. The LANL Conformed Contract (Conformed to Mod 215, 01/25/2013) tells us:

H-24 NNSA AND CONTRACTOR COMMUNITY COMMITMENTS
(a) The Contractor shall perform the activities described in the Contract’s Section J Appendices entitled “Regional Initiatives”, “Regional Purchasing Program” and “Technology Commercialization”, which sets forth the NNSA’s commitments to support the community…
(b) The Contract’s Section J Appendix entitled “Contractor and Parent Organization Commitments, Agreements, and Understandings” sets forth the Contractor’s Community Commitment plan that describes its planned activities as to how the Contractor will be a constructive partner to the communities in northern New Mexico, the eight northern pueblos, and to citizens of the State of New Mexico who should all benefit from the Contractor’s management and operation of Los Alamos National Laboratory…

2. For 2014, the Press release states the Plan will provide “$1 million for economic development such as financial and technical assistance to start and grow regional businesses. ” However, the contract states that the Lab receives a $1.8 million tax credit (per year) from the State of New Mexico for providing technical services assistance to small business. It is unclear to us what the Lab does with the other $.8 million.

4. The Press release continues that the Plan will provide “$1.1 million for educational programs and scholarships for New Mexico students and teachers as well as workforce development programs.” One of the scholarship programs that the Lab provides is the Out-of-State Tuition and Fee Waiver program. The contract explains that this program is for any LANS “full-time active employee and/or dependent who is accepted to any University of California undergraduate or graduate program. Based on the past 3 years of data, approximately 100 students will take advantage of this program annually. Out-of-state tuition and fee waiver represents a savings of $17,000 per student each year” or $1.7 million annually.

5. For meeting its community giving contract requirements, the then Lab receives an award fee on top of the regular payments. LANL’s FY 2012 Performance Evaluation Report does not give the public the exact breakout, but we know that Performance Based Initiative 11 (PBI 11: Excellence in Business and Institutional Management), which includes community giving, earned the Lab an additional $3,656,808 for 2012.

6. Not mentioned in the press release was one of the biggest gives, which is to Los Alamos Public Schools. The contract states, “The primary management and operations contractor shall provide $8.0 million in each fiscal year to the Los Alamos Public School District to support public elementary and secondary education.”

Plutonium-238 needs should be met through accelerated nuclear weapons dismantlements

Wired Magazine’s alarmist article NASA’s Plutonium Problem Could End Deep-Space Exploration argues that virgin production of plutonium-238 in nuclear reactors is needed, or U.S. space exploration is dead. Instead the nation’s future Pu-238 needs should be met through accelerated nuclear weapons dismantlements and recycling/scrap recovery efforts.

Processing and encapsulation of Pu-238 currently takes place at the Los Alamos National Laboratory in northern New Mexico. [Having said that, all plutonium operations at the Lab have been shut down since the end of June because of nuclear criticality safety issues, which is a story in and of itself]. A Pu-238 scrap recovery line capable of recovering 2-8 kilograms per year was slated to start in 2005, but apparently has never become fully operational. In fact, LANL claimed in a 2008 site-wide environmental impact statement that it was capable of recycling/recovering up to 18 kilograms of Pu-238 per year, far more than needed to take care of the nation’s needs.

LANL has a large existing inventory of Pu-238 scrap material. Moreover, the Pantex Plant was supposed to ship radioisotope thermoelectric generators (RTGs) from dismantled nuclear weapons to the Lab to harvest Pu-238. That hasn’t happened either, we conjecture because the LANL’s scrap recovery line hasn’t been properly working (or perhaps never really started in the Lab’s troubled Plutonium Facility-4). Indeed, the government estimated that approximately 3,200 RTGs would become available for recycling between 2009 and 2022 through nuclear weapons dismantlements. Significantly, increased dismantlements could also supply sufficient recycled tritium for existing nuclear weapons instead of current military production in civilian reactors, a big nonproliferation no-no. But unfortunately dismantlements at the Pantex Plant are substantially blocked by exorbitant “Life Extension Programs” that extend the service lives of existing nuclear weapons by three decades or more while giving them new military capabilities.

Before the U.S. resumes virgin Pu-238 production, the government should make LANL straighten out its Pu-238 recovery operations. Safely that is, because Pu-238 is a very energetic gamma emitter and therefore very dangerous to handle. But the nation’s future Pu-238 needs should be met through accelerated nuclear weapons dismantlements (instead of Life Extension Programs) and recycling/scrap recovery efforts, not new virgin production in nuclear reactors.

 

Abolish NNSA, but increase federal oversight and independent review

 It’s big government on steroids.

 The National Nuclear Security Administration, a division of the U.S. Department of Energy, is tasked with securing and maintaining the nation’s nuclear arsenal. It oversees Los Alamos National Laboratory and Sandia National Laboratories in New Mexico.

For years the agency’s MO has included expectations of nearly automatic budget increases, bloated projects that are never finished, duplicative red tape and a bureaucracy that resists efforts to rein it in.

Critics say it has become a massive jobs program.

Ten of its major projects are collectively over budget to the tune of $16 billion and behind schedule by 38 years, according to the U.S. Government Accountability Office. For instance, at LANL a new $213 million security system to protect sensitive nuclear bomb-making facilities doesn’t work. So, taxpayers are being asked to lay out an additional $41 million to fix it.

The chairwoman of the Senate Homeland Security subcommittee that oversees finances and contracts largely blames the agency’s reliance on private contractors – more than 92,000. LANL and Sandia are operated by private contractors, LANL by a consortium led by Bechtel, and Sandia by Lockheed Martin.

Former Lockheed Martin CEO Norman Augustine told Congress this spring that accountability and internal structure problems pose a national security risk. And there’s no doubt NNSA’s work is critical to U.S. national security, but taxpayers also are tired of watching their money being thrown at an insatiable beast that too often fails to deliver results.

As long as the NNSA remains impervious to calls for improving its culture and tightening up its accountability, the inefficiencies and waste will keep coming.

A congressionally appointed panel recently began studying whether to overhaul the agency. (Former Sen. Jeff Bingaman had said he was open to just getting rid of it.) Energy Secretary Ernest Moniz says the review is a chance to “have this dialogue and reach a conclusion.”

It’s way past time for that talk. The panel should come up with a well-thought-out plan to either overhaul NNSA from top to bottom or outright kill it and let the DOE take on its oversight duties.

This editorial first appeared in the Albuquerque Journal. It was written by members of the editorial board and is unsigned as it represents the opinion of the newspaper rather than the writers.

Abolish NNSA, but increase federal oversight and independent review

Kudos for the editorial “Time past for coddling bloated nuclear agency.” The money the National Nuclear Security Administration (NNSA) has wasted on out-of-control nuclear weapons projects is appalling. Some examples are the Chemistry and Metallurgy Research Replacement Project at Los Alamos (estimated costs exploded from $660 million to $5.8 billion), the failed National Ignition Facility at the Livermore Lab in California ($1 billion to $5 billion), the MOX Fuel Fabrication Facility in South Carolina ($1 billion to $7 billion), and now the Uranium Processing Facility at the Y-12 Plant in Tennessee ($1 billion to $10 billion).

Despite all this chronic mismanagement NNSA’s proposed budget was increased 17% above FY 2013 sequester levels. That’s right, the guilty were rewarded, while schools, firefighting, environmental protection, etc. were cut.

But while NNSA is truly dysfunctional, its contractors deserve more scrutiny as well. After all, the agency is simply out manned, with some 2,600 (and declining) employees trying to oversee more than 50,000 contractor employees nation-wide. Moreover, these contractors have inherent conflicts-of-interest. For instance, the lab directors wear two hats, first as those responsible for annual certification of the safety, security and reliability of the nuclear weapons stockpile, which gives them enormous leverage. Their second hat is as presidents of the executive boards of the for-profit corporations running the labs. How can we be sure they are always acting in the best interests of the country while they are pushing a never-ending cycle of extremely costly “Life Extension Programs” for existing nuclear weapons? Ironically, these programs may actually erode confidence in stockpile reliability by intentionally introducing major changes that can’t be full-scale tested.

As your editorial noted a congressionally appointed panel is beginning to study the NNSA’s future. I make some recommendations for that panel:

•     The NNSA is a failed experiment and should be abolished. Its nuclear weapons programs should revert back to “Defense Programs” within the Department of Energy, as it was pre-2000.

•     As guarantors of the nuclear weapons stockpile, the lab directors should be just lab directors, their jobs institutionally insulated from the for-profit motivations of the private corporations running the labs.

•     Duplicative bureaucratic red tape should be eliminated, but federal oversight should be increased, not decreased (witness a protesting 82-year-old nun infiltrating an extremely sensitive area at Y-12 despite contractor security assurances). Concrete benchmarks need to be put back into now toothless annual Performance Evaluation Plans so that contractors are held truly accountable. NNSA’s past practice of granting waivers for poor performance while handing out contract extensions (as was done for the Los Alamos and Livermore Labs) must end.

•     DOE should be required to seek concurrence from the congressionally chartered Defense Nuclear Facilities Safety Board early in the design of nuclear facilities. Past NNSA delays in meeting safety concerns have been a prime driver of exploding project costs.

•     Congress should establish a stringent change control process for nuclear weapons, including a requirement for outside review of all proposed major changes. Because the labs lack conservatism in maintaining the pedigree of tested, reliable designs, independent expert review could save 100’s of billion of dollars over the next few decades and help maintain confidence in stockpile reliability. As a past example, a group of eminent independent scientists called the JASONs found that the cores of nuclear weapons, the plutonium pits, have reliable life times of around a century, in contrast to NNSA’s previous claims of 45 years. This helped to convince Congress to delete funding for NNSA’s proposed, enormously expensive new-design nuclear weapons and related expanded plutonium pit production.

•     Finally, the congressionally appointed panel deliberating on NNSA’s future should itself be above reproach. One member, former Congresswoman Heather Wilson, pocketed $450,000 in no-bid “consulting” contracts with the Los Alamos and Sandia Labs, in between her terms representing New Mexico’s First District and her Senate campaign that largely championed the labs. She should resign from the panel so that its future recommendations are not tainted by her clear conflict-of-interest.

Report Reveals That Little is Known About Lab’s Future Plutonium Needs
Except LANL Contractor Needs Money

A Government Accountability Office (GAO) report reveals how the future of expanded nuclear weapon component production at Los Alamos is unknown. The public has had enough of half-baked billion-dollar plans for nuclear facilities that do nothing but line contractors’ pockets. Congress must put away the check book and realize that the Lab’s plutonium future is unknown because it is unneeded.

Let’s get some details out of the way –

Los Alamos National Laboratory (LANL) houses most of the nation’s capabilities for plutonium research and development in support of the nuclear weapons mission. In addition, LANL’s scientists and technicians also perform research on plutonium to support other missions, such as conducting research on recycling plutonium for use as fuel in commercial nuclear reactors (MOX).

The National Nuclear Security Administration (NNSA), a separately organized agency within the Department of Energy (DOE), is responsible for the management of the nation’s nuclear weapons.

Plutonium pits are the fissile cores of modern nuclear weapons (fissile means capable of sustaining a nuclear reaction). When a nuclear weapon is detonated the pit is explosively compressed into a critical mass that rapidly begins atomic fission. In modern two-stage weapons the plutonium pit acts as the primary (or “trigger”) that initiates fusion in the thermonuclear secondary. Each pit is an atomic bomb in its own right, similar to the Trinity and Nagasaki bombs, both of which were plutonium bombs. In thermonuclear or hydrogen bombs the plutonium pit serves as the trigger that detonates the far more powerful fusion explosion characteristic of hydrogen bombs.

(The need for any more nuclear weapons production ever is actually zero.)

NNSA claims that the need is unknown –
Because of public participation, lack of need, and budget concerns, construction of the Lab’s $6 billion Chemistry and Metallurgy Research Replacement (CMRR) nuclear facility was deferred for at least five years starting in 2012. The CMRR would have enabled a production capacity of 50-80 pits per year. Theoretically, the Lab is currently capable of producing 10-20 pits per year, maybe. But it produced zero this year.

It is now unclear when or if the CMRR nuclear facility will be built, which the Lab claims may lead to insufficient capabilities to meet LANL’s plutonium research requirements. But no one really can say what these requirements are.

The report states the uncertainty–

The Nuclear Weapons Council is still evaluating specifications for nuclear weapons and their corresponding life extension program schedules, and it may take another year or two before final decisions are made, according to NNSA officials. Since the schedule has not been finalized, the number of pits that will be needed is uncertain as well. (Pg. 10)

Officials have announced that they are seeking alternatives to the CMRR that would provide the capabilities planned for the CMRR nuclear facility using existing facilities. This would be replacing deferred unneeded capabilities with unneeded capabilities. Instead of trying to replace the lacking capabilities of the CMRR, NNSA should first describe the actual pit needs, which are none.

Meanwhile, “NNSA has estimated that it needs to be able to ramp up its capabilities to manufacture about 30 pits each year by 2021” to meet expected life extension program requirements. (Life extension programs are intended to lengthen the lives of existing nuclear weapons by 20 to 30 years by repairing or replacing nuclear weapons components as needed.)

But the 30 number is just a guess “for planning purposes”.
For planning purposes, NNSA is studying the possibility of manufacturing about 30 pits per year… (Pg.10)
“Studying the possibility” is not a need.

NNSA now believes that LANL can support the manufacture of 30 pits per year just by upgrading its radiological laboratory and by repurposing available space in its existing plutonium facility. (Pg. 12)

Also,
Costs are unknown –
The cost estimates were characterized as “high-level and a rough order of magnitude and noted that the estimates should be viewed as preliminary and preconceptual that would not be useful for program definition or scoping.” (pg.15)

Staffing is unknown.

NNSA and LANL officials told us that recruiting additional staff for plutonium-related research necessarily takes years of advance planning, but that the uncertainty of where the new capabilities will be located or what the level of capacity is needed has complicated planning efforts. (Pg. 17)

What is know is the public is a problem –

Plans for transporting plutonium or other radioactive materials from LANL to facilities at other sites could also spur public opposition that may cause schedule delays or create other impediments…

A Guide to “Scoping” the New LANL SWEIS

“Scoping” means determining the issues that should be included in public analyses required by the National Environmental Policy Act (NEPA) of proposed major actions by the federal government. According to the Department of Energy ‘s own NEPA implementation regulations, DOE must prepare a new or supplemental site-wide environmental impact statement (SWEIS) for its major sites when there are “significant new circumstances or information relevant to environmental concerns.” The last site-wide EIS for the Los Alamos National Laboratory (LANL) was completed in 2008 and is badly outdated. Moreover, since 2018 the National Nuclear Security Administration (NNSA), DOE’s semi-autonomous nuclear weapons agency, has been aggressively expanding the production of plutonium “pit” bomb cores for nuclear weapons at the Lab.

On August 19, 2022, NNSA finally announced its intent to prepare a new LANL SWEIS, but apparently the agency will not address expanded plutonium pit production.1 NNSA’s dubious argument is that it performed the legally required NEPA analysis for expanded plutonium pit production in a 2008 Complex Transformation Programmatic Environmental Impact Statement, the 2008 LANL SWEIS and a woefully inadequate “Supplement Analysis” in 2020 that concluded a new SWEIS was not needed. 2 3

Issues That Must Be Addressed in a New LANL SWEIS

This is meant to be a guide to (or list of) the issues that must be addressed in a new draft LANL SWEIS. It is not completely exhaustive, nor is it a comprehensive fact sheet on the substance of the issues. Nuclear Watch New Mexico will offer suggested scoping comments for interested citizens and submit its own comprehensive formal comments before the October 3 deadline or extended deadline (see “Timing” below).

THE NEED FOR A PROGRAMMATIC ENVIRONMENTAL IMPACT STATEMENT: This is our first and primary concern, that NNSA must first complete a programmatic environmental impact statement (PEIS) on its nation-wide plans for plutonium pit production, in advance of the Savannah River Site-specific environmental impact statement. To get right to the point, we argue that the SRS EIS process should go no further than this scoping period and should resume only after a completed formal Record of Decision for a new or supplemental PEIS.

Federal Government Meets Watchdogs’ Demand for Environmental Review of Expanded Plutonium Pit Production

Noted Environmental Lawyers Warn Government Not to Expand Production of Plutonium Bomb Cores in Violation of National Environmental Policy Act and Public Review

On behalf of three public interest organizations - Nuclear Watch New Mexico, Tri-Valley Communities Against a Radioactive Environment and Savannah River Site Watch – attorneys for the law firm of Meyer Glitzenstein & Eubanks and the Natural Resources Defense Council recently sent a 16-page letter to Lisa Gordon-Hagerty, head of the National Nuclear Security Administration (NNSA). The detailed letter warns the nuclear agency to not proceed with aggressive plans to expand plutonium pit production without first meeting its legal requirements for timely public review and comment under the National Environmental Policy Act.

Faulty Radioactive Liquid Waste Valves Raise Crucial Plutonium Pit Production and Safety Board Issues

Last Wednesday, facility operations personnel entered a service room and noticed a leak emanating from a valve on the radioactive liquid waste (RLW) system. Upon subsequent visual inspection by a radiological control technician, RLUOB engineers believe that this valve, and 6 similar valves, may be constructed of carbon steel. The RLW system handles radioactive liquid waste streams from chemistry operations that include nitric and hydrochloric acids—carbon steel valves would be incompatible with these solutions. The suspect valves are also in contact with stainless steel piping, which would create another corrosion mechanism. RLUOB management plans to drain the affected piping sections and develop a work package to replace all of the suspect valves. They will also confirm the valve materials and if shown to be incorrect, investigate the cause of this failure in the design, procurement, and installation processes. The valves were installed in 2013 as part of a modification to add straining and sampling capabilities that were not in the included in the original design. [Please note that DNFSB reports are posted a few weeks later than dated.]

This immediately raises two crucial issues: 1) the National Nuclear Security Administration’s (NNSA’s) plans for expanded plutonium pit production; and 2) the current attempt by the Department of Energy to restrict Safety Board access to its nuclear weapons facilities.

A Tale of Two Consent Orders and What Is Needed

On March 1, 2005, after arduous negotiations and threats of litigation, the New Mexico Environment Department (NMED), Department of Energy (DOE), and Los Alamos National Laboratory (LANL) entered into a Consent Order specifying the schedule for investigation and cleanup of the Lab’s hundreds of contaminated sites. This Consent Order (CO) was LANL’s agreement to fence-to-fence cleanup of Cold War legacy wastes, which NMED began to enforce.

Global Nuclear Weapons Threats Are Rising

More than 25 years after the end of the Cold War, all eight established nuclear weapons powers are “modernizing” their stockpiles. Talks have broken down with North Korea, the new nuclear weapons power. Nuclear-armed India and Pakistan narrowly averted war last month. Russian President Vladmir Putin made new nuclear threats in response to Trump’s announced withdrawal from the Intermediate-Range Nuclear Forces Treaty. This could lead to hair-trigger missile emplacements in the heart of Europe and block extension of the New Strategic Arms Reduction Treaty with Russia. If so, the world will be without any nuclear arms control at all for the first time since 1972. Meanwhile, the U.S. criticizes non-weapons states for signing a nuclear weapons ban treaty, despite the fact there have long been treaties completely banning chemical and biological weapons of mass destruction that the U.S. seeks to enforce. The pending international NonProliferation Treaty (NPT) Preparatory Committee conference at the United Nations is widely expected to collapse in failure because of the nuclear weapons powers’ failure to enter into serious negotiations leading to nuclear disarmament. The NPT’s Article VI mandate for those negotiations has been in effect since 1970, when the Treaty was signed by 189 countries (more than any other treaty).

Expanded Plutonium Pit Production for U.S. Nuclear Weapons

Plutonium pits are the radioactive cores or “triggers” of nuclear weapons. Their production has always been a chokepoint of resumed industrial-scale U.S. nuclear weapons production ever since a 1989 FBI raid investigating environmental crimes shut down the Rocky Flats Plant near Denver. In 1997 the mission of plutonium pit production was officially transferred to its birthplace, the Los Alamos National Laboratory (LANL) in northern New Mexico, but officially capped at not more than 20 pits per year. However, in 2015 Congress required expanded pit production by 2030 whether or not the existing nuclear weapons stockpile actually needs it. This will support new military capabilities for nuclear weapons and their potential use.

Watchdog Groups Claim Nuclear Agency is Moving Forward to Manufacture New Plutonium Bomb Cores in Violation of National Environmental Law and Public Review

Nuclear Watch New Mexico, Savannah River Site Watch, and Tri-Valley CAREs sent a letter of demand to the U.S. Department of Energy’s National Nuclear Security Administration (NNSA) to inform the government that its plan to quadruple the production rate of plutonium bomb cores is out of compliance with the National Environmental Policy Act (NEPA).

NNSA’s premature plan to quadruple the production rate of plutonium bomb cores (“pits”), the heart of all US nuclear weapons, is out of compliance with requisite environmental law, the groups argue, as NNSA has failed to undertake a legally-mandated programmatic review and hold required public hearings.

DNFSB Hearing - Formal Comments

New Contractors Selected For Expanded Nuclear Weapons Production at Los Alamos

Santa Fe, NM. Today the Department of Energy's National Nuclear Security Administration (NNSA) announced its choice for the new management and operating contract for the Los Alamos National Laboratory (LANL).The new contractor, Triad National Security, LLC, is a limited liability company consisting of the Battelle Memorial Institute, the University of California and Texas A&M University. All three are non-profits, and it is unclear how this will affect New Mexico gross receipts taxes.

Battelle claims to be the world's largest non-profit technology research and development organization, and manages a number of labs including the Lawrence Livermore and Idaho National Laboratories. Texas A&M was founded in 1876 as the state's first public institution of higher learning and has the largest nuclear engineering program in the country. DOE Secretary Rick Perry is an avid A&M alumnus.

What's Not in NNSA's Plutonium Pit Production Decision

 

- NNSA did not mention that up to 15,000 "excess" pits are already stored at the Pantex Plant near Amarillo, TX, with up to another 5,000 in "strategic reserve." The agency did not explain why new production is needed given that immense inventory of already existing plutonium pits. (In 2006 independent experts found that pits last a least a century. Plutonium pits in the existing stockpile now average around 40 years old.)
- NNSA did not explain how to dispose of all of that plutonium, given that the MOX program is an abysmal failure. Nor is it made clear where future plutonium wastes from expanded pit production will go since operations at the troubled Waste Isolation Pilot Plant are already constrained from a ruptured radioactive waste barrel, and its capacity is already overcommitted to existing radioactive wastes. United States To Begin Construction Of New Nuclear Bomb Plant

The National Nuclear Security Administration (NNSA) announced on Friday, March 23, that it was authorizing the start of construction of the Uranium Processing Facility (UPF) and two sub-projects at the Y-12 National Security Complex in Oak Ridge, Tennessee. The UPF is a facility dedicated solely to the manufacture of thermonuclear cores for US nuclear bombs and warheads.
Citizen watchdog groups are responding by filing an expedited Freedom of Information Act request demanding a full fiscal accounting of the UPF bomb plant- something the NNSA has refused to provide for the last five years, including to Congress, despite repeated assurances that the project is "on budget."

"This project is already a classic boondoggle, and they are just getting started," said Ralph Hutchison, coordinator of the Oak Ridge Environmental Peace Alliance (OREPA) in Knoxville, Tennessee. "Worse, it undermines US efforts to discourage nuclear proliferation around the world. How can we oppose the nuclear ambitions of other countries when we are building a bomb plant here to manufacture 80 thermonuclear cores for warheads every year?"

Jay Coghlan of NukeWatch points out that "This project already has a long history, and it is instructive. In 2013, DOE announced it was 85% finished with the UPF design when it ran into the 'space/fit' issue- and more than a half-billion taxpayer dollars were just written off. In private business, that kind of thing gets you fired. In DOE's world of contractors running amok, they not only didn't get fired, not one Congressional hearing was held and the UPF budget went up the next year!"

The Regional Coalition of LANL Communities: Benefits for the Select Few

Santa Fe, NM- According to media reports, Andrea Romero, Executive Director of the Regional Coalition of LANL Communities, is accused of charging some $2,200 dollars of unallowable travel costs, such as alcohol and baseball tickets, while lobbying in Washington, DC for additional funding for the Los Alamos National Laboratory (LANL). She in turn accused the nonprofit group Northern New Mexico Protects of political motivations in revealing these questionable expenses. Romero is running in the Democrat Party primary against incumbent state Rep. Carl Trujillo for Santa Fe County's 46th district in the state House of Representatives.
Perhaps more serious is the fact that Romero was awarded an undisclosed amount of money by the Venture Acceleration Fund (VAF) for her private business Tall Foods, Tall Goods, a commercial ostrich farm in Ribera, NM. According to a May 8, 2017 Los Alamos Lab news release announcing the award to Tall Foods, Tall Goods, "The VAF was established in 2006 by Los Alamos National Security [LANS], LLC to stimulate the economy by supporting growth-oriented companies."[1] LANS, primarily composed of the Bechtel Corporation and the University of California, has held the annual ~$2.4 billion Los Alamos National Laboratory (LANL) management contract since June 2006.

Major LANL Cleanup Subcontractor Implicated in Fraud - Entire Los Alamos Cleanup Should Be Re-evaluated

Santa Fe, NM. On December 17, 2017, the Department of Energy (DOE) awarded a separate $1.4 billion contract for cleanup at the Los Alamos National Laboratory (LANL) to Newport News Nuclear BWXT-Los Alamos, LLC (also known as "N3B"). This award followed a DOE decision to pull cleanup from LANL's prime contractor, Los Alamos National Security, LLC (LANS), after it sent an improperly prepared radioactive waste drum that ruptured underground at the Waste Isolation Pilot Plant (WIPP). That incident contaminated 21 workers and closed WIPP for nearly three years, costing taxpayers at least $1.5 billion to reopen.
Tetra Tech Inc is a major subcontractor for N3B in the LANL cleanup contract... Serious allegations of fraud by Tetra Tech were raised long before the LANL cleanup contract was awarded. The US Navy found that the company had committed wide spread radiological data falsification, doctored records and supporting documentation, and covered-up fraud at the Hunters Point Naval Shipyard cleanup project in San Francisco, CA. Detailed NNSA Budget Documents Accelerates Nuclear Weapons Arms Race

Santa Fe, NM. Late Friday February 23, the Trump Administration released the detailed FY 2019 budget for the National Nuclear Security Administration (NNSA), the semi-autonomous nuclear weapons agency within the federal Department of Energy. Overall, NNSA is receiving a $2.2 billion boost to $15.1 billion, a 17% increase above the FY 2018 enacted level. Of that, a full $11 billion is for the budget category [Nuclear] "Weapons Activities", 18% above the FY 2018 level. Of concern to the American taxpayer, DOE and NNSA nuclear weapons programs have been on the congressional Government Accountability Office's High Risk List for project mismanagement, fraud, waste and abuse since its inception in 1990...

NNSA Releases Draft Environmental Assessment for LANL Rad Lab; Raises Plutonium Limit 10 Times for Expanded Pit Production

Santa Fe, NM. Today the National Nuclear Security Administration announced an Environmental Assessment to increase the amount of plutonium used in the Radiological Laboratory Utility and Office Building (aka the "Rad Lab") at the Los Alamos National Laboratory from 38.6 grams of plutonium-239 equivalent to 400 grams. This 10-fold increase is significant because it will dramatically expand materials characterization and analytical chemistry capabilities in the Rad Lab in support of expanded plutonium pit production for future nuclear weapons designs. It also re-categorizes the Rad Lab from a "radiological facility" to a "Hazard Category-3" nuclear facility.

Trump's Budget Dramatically Increases Nuclear Weapons Work

Santa Fe, NM In keeping with the Trump Administration's recent controversial Nuclear Posture Review, today's just released FY 2019 federal budget dramatically ramps up nuclear weapons research and production.
The National Nuclear Security Administration (NNSA), the Department of Energy's semi-autonomous nuclear weapons agency, is receiving a $2.2 billion overall boost to $15.1 billion, a 17% increase above the FY 2018 enacted level. Of that, a full $11 billion is for the budget category (Nuclear) "Weapons Activities", 18% above the FY 2018 level.

Draft Nuclear Posture Review Degrades National Security

Yesterday evening the Huffington Post posted a leaked draft of the Trump Administration's Nuclear Posture Review (NPR). This review is the federal government's highest unclassified nuclear weapons policy document, and the first since the Obama Administration's April 2010 NPR.
This Review begins with "Many hoped conditions had been set for deep reductions in global nuclear arsenals, and, perhaps, for their elimination. These aspirations have not been realized. America's strategic competitors have not followed our example. The world is more dangerous, not less." The NPR then points to Russia and China's ongoing nuclear weapons modernization programs and North Korea's "nuclear provocations." It concludes, "We must look reality in the eye and see the world as it is, not as we wish it be."
If the United States government were to really "look reality in the eye and see the world as it is", it would recognize that it is failing miserably to lead the world toward the abolition of the only class of weapons that is a true existential threat to our country. As an obvious historic matter, the U.S. is the first and only country to use nuclear weapons. Since WWII the U.S. has threatened to use nuclear weapons in the Korean and Viet Nam wars, and on many other occasions.
Further, it is hypocritical to point to Russia and China's "modernization" programs as if they are taking place in a vacuum. The U.S. has been upgrading its nuclear arsenal all along. In the last few years our country has embarked on a $1.7 trillion modernization program to completely rebuild its nuclear weapons production complex and all three legs of its nuclear triad.
Moreover, Russia and China's modernization programs are driven in large part by their perceived need to preserve strategic stability and deterrence..

New Mexico Environment Department Surrendered to DOE Extortion

Santa Fe, NM. The New Mexico State Auditor Office recently questioned whether two settlements between the New Mexico Environment Department and the Department of Energy were in the best interests of New Mexico. That Office noted:
"The New Mexico Environment Department unnecessarily forgave tens of millions of dollars in civil penalties related to various waste management issues and missed cleanup deadlines by the Department of Energy (DOE) and its contractors. Considering the seriousness of the violations, and the clarity regarding responsibility for the violations, it appears highly unusual that the Department would not collect any civil penalties under these circumstances."
NMED completed an assessment of $54 million in penalties that would have gone to New Mexico, but did not enforce them before making the settlements with DOE. This was at a time when the state was beginning to face a serious budget crisis. As State Senator John Arthur Smith (Chair of the Senate Finance Committee) put it, NMED's failure to levy penalties when New Mexico was facing a budget crisis is "taking it out of the pockets of our kids and young people when they do something like that."
Jay Coghlan, Director of Nuclear Watch New Mexico, commented, "This is inexcusable that NMED preemptively surrendered to Department of Energy extortion. In effect DOE is saying if you, the regulator, fine us, we will cut the money the taxpayer has paid to clean up our mess that threatens the citizens you are suppose to protect."

Los Alamos Hires New Contractor - Starts Cleanup On the Cheap

Santa Fe, NM- Today the Department of Energy (DOE) announced the award of the new Los Alamos National Laboratory legacy cleanup contract to Newport News Nuclear BWXT-Los Alamos, LLC. The $1.39 billion contract is for ten years, which works out to $139 million per year...
Jay Coghlan, Director of Nuclear Watch New Mexico, commented, "This dooms the Lab to cleanup on the cheap. This 140 million dollars per year to the cleanup contractor is based on a revised Consent Order by the New Mexico Environment Department that was a give away to the Los Alamos Lab. The original 2005 Consent Order held the Department of Energy's feet to the fire to complete real cleanup or pay stipulated penalties. In contrast, the Martinez administration gave the biggest polluter in northern New Mexico a free pass, forgiving a hundred million dollars in possible fines that should have gone to our kids' schools. New Mexicans deserve an Environment Department under a new governor that aggressively protects the environment and creates new high-paying jobs thorough enforcing comprehensive cleanup."

Congressional Budget Office: Cost of Nuclear Weapons Upgrades and Improvements Increases to $1.2 Trillion

Today, in Washington, DC, the Congressional Budget Office released its new report, "Approaches for Managing the Costs of U.S. Nuclear Forces, 2017 to 2046". The Congressional Budget Office estimates that the most recent detailed plans for nuclear forces, which were incorporated in the Obama Administration's 2017 budget request, would cost $1.2 trillion in 2017 dollars over the 2017-2046 period: more than $800 billion to operate and sustain (that is, incrementally upgrade) nuclear forces and about $400 billion to modernize them.... Driving this astronomical expense is the fact that instead of maintaining just the few hundred warheads needed for the publicly claimed policy of "deterrence," thousands of warheads are being refurbished and improved to fight a potential nuclear war. This is the little known but explicit policy of the U.S. government!

Santa Fe City Council: LANL Cleanup Order Must Be Strengthened & Expanded and Plutonium Pit Production Suspended Until Safety Issues Are Resolved

Santa Fe, NM. On the evening of Wednesday October 25, the Santa Fe City Council passed a resolution requesting that the New Mexico Environment Department strengthen the revised Los Alamos National Labs cleanup order to call for additional characterization of legacy nuclear wastes, increased cleanup funding, and significant additional safety training. The resolution also called for the suspension of any planned expanded plutonium pit production until safety issues are resolved.

Expanded Plutonium Pit Production at LANL Will Not Result in Significant Positive Effect On Job Creation and the Regional Economy

The National Nuclear Security Administration's own documents have explicitly stated that expanded pit production would have no significant positive effect on job creation and the regional economy of northern New Mexico. Nuclear Watch argues that expanded plutonium pit production could actually have negative effect if it blocks other economic alternatives such as comprehensive cleanup, which could be the real job producer. Moreover, given LANL's poor safety and environmental record, expanded plutonium pit production could have a seriously negative economic impact on northern New Mexico in the event of any major accidents.

Chromium Groundwater Contamination at Los Alamos Lab Far Greater Than Previously Expected; LANL's Treatment Plan Must Be Drastically Changed

The Los Alamos National Laboratory (LANL) has detected far more hexavalent chromium (Cr) contamination than previously estimated in the "sole source" regional groundwater aquifer that serves Los Alamos, Santa Fe and the Espanola Basin. Sampling in July from a new well meant to inject treated groundwater back into the aquifer detected chromium contamination five times greater than the New Mexico groundwater standard of 50 micrograms per liter (ug/L).

Talking Points: The 2016 LANL Cleanup Consent Order Should Be Rescinded

The 2005 LANL Cleanup Consent Order was all about the enforceable schedules. It required DOE and LANL to investigate, characterize, and clean up hazardous and mixed radioactive contaminants from 70 years of nuclear weapons research and production. It stipulated a detailed compliance schedule that the Lab was required to meet. Under Gov. Martinez, NMED Secretary Ryan Flynn granted more than 150 compliance milestone extensions at the Lab's request, effectively eviscerating it.
In June 2016 the New Mexico Environment Department (NMED), the Department of Energy (DOE) and Los Alamos National Security, LLC (LANS) signed a revised Consent Order governing cleanup at the Los Alamos National Laboratory (LANL). The new Consent Order is a big step backward in achieving comprehensive, genuine cleanup at the Lab. The revised 2016 CO was a giveaway by NMED to DOE and the Lab, negotiated to allow DOE's budget to drive cleanup, not what is needed to permanently protect our water.
NMED should have kept the original, enforceable 2005 Consent Order that it fought so hard for under the Richardson Administration, modified as needed for the cleanup schedule and final compliance date.

Oak Ridge Environmental and Peace Alliance, Nuclear Watch New Mexico, and The Natural Resources Defense Council File Lawsuit Against New Nuclear Bomb Plant

Washington, DC Today, the Oak Ridge Environmental Peace Alliance (OREPA), Nuclear Watch New Mexico, and the Natural Resources Defense Council filed a federal lawsuit to stop construction of the problem-plagued Uranium Processing Facility (UPF) until legally required environmental review is completed. The UPF, located at the National Nuclear Security Administration's (NNSA's) Y-12 production plant near Oak Ridge, TN, is slated to produce new thermonuclear weapons components until the year 2080. The UPF is the tip of the spear for the U.S.'s planned one trillion dollar-plus make over of its nuclear weapons arsenal, delivery systems, and production plants.
"The story of this new bomb plant is a long tale of outrageous waste and mismanagement, false starts and re-dos, a federal agency that refuses to meet its legal obligation to engage the public, and a Senator that is bent on protecting this piece of prime nuclear pork for his home state," said Ralph Hutchison, coordinator of OREPA. "But the short version is this: when the NNSA made dramatic changes to the UPF, and admitted that it intends to continue to operate dangerous, already contaminated facilities for another twenty or thirty years, they ran afoul of the National Environmental Policy Act. Our complaint demands that the NNSA complete a supplemental environmental impact statement on the latest iteration of its flawed plans."

Some Background on Plutonium Pit Production at the Los Alamos Lab

Santa Fe, NM -The Washington Post has published the first in a series of articles on nuclear safety lapses in plutonium pit production at the Los Alamos Lab. Plutonium pits are the fissile cores of nuclear weapons that when imploded initiate the thermonuclear detonation of modern weapons. By the way, did you know? Plutonium facilities at LANL are- in principle- designed to withstand a serious earthquake of a degree expected to occur only once every 10,000 years. The last serious earthquake near the Lab is believed to have occurred 11,500 years ago.

SA Preview of Trump's Budget: More Nuclear Bombs and Plutonium Pit Production

Santa Fe, NM. "The proposed level of funding for the National Nuclear Security Administration's (NNSA)'s Total Weapons Activities is $10.2 billion, a full billion above what was requested for FY 2017. In March, Trump's "skinny budget" stated NNSA's funding priorities as 'moving toward a responsive nuclear infrastructure', and 'advancing the existing warhead life extension programs'.
"Concerning Life Extension Programs, rather than merely maintaining and extending the lives of existing nuclear weapons as advertised, they are being given new military capabilities, despite denials at the highest levels of government. A current example is the B61-12 Life Extension Program, which is transforming a "dumb" nuclear bomb into the world's first highly accurate "smart" nuclear bomb.
"With respect to the Los Alamos National Laboratory (LANL), "responsive infrastructure" no doubt means accelerating upgrades to existing plutonium facilities and likely building two or three new underground "modules", all for the purpose of quadrupling plutonium pit production from 20 to 80 pits per year. (Plutonium pits are the fissile cores of nuclear weapons.)”

Costs Jump in Nuclear Weapons vs. Cleanup; Nuclear Weapons Winning over Environmental Protection

Santa Fe, NM. America is at a crossroads, having to choose between an unnecessarily large, exorbitant, nuclear weapons stockpile, and cleanup that would protect the environment and water resources for future generations. Expanded nuclear weapons research and production, which will cause yet more contamination, is winning.
Two recently released government reports make clear the stark inequality between the so-called modernization program to upgrade and indefinitely preserve U.S. nuclear forces (in large part for a new Cold War with Russia), and the nation-wide program to clean up the radioactive and toxic contamination from the first Cold War. The Obama Administration launched a trillion dollar nuclear weapons "modernization" program, which President Trump may expand. In contrast, cleanup of the first Cold War mess has been cut from a high of $8.5 billion in 2003 to $5.25 billion in 2016, even though comprehensive cleanup would produce far more jobs than nuclear weapons programs.

NNSA Releases Los Alamos Lab Performance Evaluation Report,Nuclear Criticality Safety Issues Still Not Fully Resolved

The National Nuclear Security Administration (NNSA) has publicly released its fiscal year 2016 Performance Evaluation Report (PER) for Los Alamos National Security, LLC (LANS), the for-profit contractor that runs the Los Alamos Lab. The Performance Evaluation Report is NNSA's annual report card on contractor performance, and overall the agency awarded LANS $59 million in profit out of a possible $65 million. The grade was 85% for the incentive part of the award. In 2012 Nuclear Watch New Mexico successfully sued NNSA to ensure that the Performance Evaluation Reports detailing taxpayers funds paid to nuclear weapons contractors are publicly available. In 2016 the NNSA decided to put the LANL management contract out for competitive bid, but granted LANS a contract extension until the end of September 2018.
Despite the passing grade that NNSA gave LANS, there is still ample reason for public concern. First, it bears repeating that in February 2014 a radioactive waste drum improperly prepared by the Los Alamos National Laboratory (LANL) burst underground at the Waste Isolation Pilot Plant (WIPP), contaminating 21 workers and closing that multi-billion dollar facility (a limited restart of operations at WIPP may occur this month).
Less widely known is the fact that LANL's main plutonium facility that produces WIPP wastes has only recently restarted operations after being shut down since June 2013 because of nuclear criticality safety concerns... (more: read full press release)
